BUTLER TWP., Montgomery County — A woman’s BlackBerry cell phone saved her from serious harm after her boyfriend’s concealed handgun discharged inside a restaurant.

The incident occurred about 11 p.m. Saturday, Feb. 6, in Fricker’s on Miller Lane, said Butler Twp. police Capt. Carl Bush.

The gun owner, Anthony J. Holtvogt, 24, of Kettering holds a concealed carry permit for the firearm.

He faces one charge of possession of a firearm in a liquor permit premises. The third-degree felony is punishable by up to five years in prison and a $10,000 fine.

Bush said Holtvogt, his girlfriend, 22, and other friends were enjoying beers at Fricker’s, 6834 Miller Lane. The girlfriend lives in Butler Twp.

When they prepared to leave, Holtvogt told police, he picked up his coat and began putting it on. The firearm was in the coat pocket.

The sleeve got caught in the coat, and as Holtvogt reached down, he noticed the slide on the .32-caliber handgun was pulled back. The gun then discharged.

The slug put a hole through his coat and his girlfriend’s jeans, but struck the BlackBerry in her left pants pocket dead center, Bush said. The bullet caused only bruising, and the woman declined medical treatment, Bush said.

“The BlackBerry saved her absolutely,” Bush said. “It could have been pretty serious.”

If Holtvogt is convicted, he faces a mandatory revocation of his concealed carry permit, Bush said.

The Montgomery County Sheriff’s Office, which issues the permits, has been notified, Bush said.

Ok, lets break this down, taking the report at face value.
It sounds like an AD, rather than an ND. Either way, no intent, horse play, drunkeness or other BS. Only fault is not using a pocket holster.
5 years for being in a retraurant just because they sold beer? Are these people on crack? WTF?
If the blackberry deflected th bullet as reported, what does this say about .32 as a defensive weapon?

Ohio law makes it very clear, and it is required that you sign a notice of understanding before getting your CCW, that you CANNOT carry in locations that sell alcohol for consumption on premises. End of story. He can say goodbye to his permit and probably his gun in this state. They will more than likely pursue this. Ohio is getting more and more Sheriffs that don't like us having guns.

Thought .50 GI was a Glock thing? Truly said though except for those of us who carry full sized .45s all the time... (or .40s with one shot shy of 50 rounds on us all the time... wink wink....)

Iphone has a tempered glass face, so believe it or not, the Apple shit isn't as wussy pants as you may think... My Droid is all Aluminium and Tempered Glass so it is much more ballistic protection than three Blackberries or two Iphones 8).... LMAO

This really does not say anything about the little .32...... There have been many a story about random things stopping very manly caliber bullets -- Bible, cop badge, cig lighter, you name it. Bullets do strange things when they strike objects they were not deisgned to kill. You could probably shoot 100 blackberrys with a .32 or smaller and I would bet that 9 times out of 10 it would penetrate...... The thing I found so interesting is how many layers of garments it went through (heavy winter coat and denim)..... Thats usually the biggest gripe about mouse guns.

Glad she was OK (I never want to see someone get hurt by an AD/ND).  The guy is screwed, Plaxico style.  He may be able to get down to a misdemeanor and keep his 2nd amendment rights, if he is lucky and has enough money to lawyer up real good.

Isn't OH where you are REQUIRED to carry in a holster?  plus their bar law is pretty restrictive.
