Title: How do we go about doing this?
Post by: JC5123 on March 23, 2010, 12:05:44 PM
I have thought long and hard about this. The simple solution is to add an amendment to the constitution that states that congress cannot exempt themselves from any legislation they enact. I think that things would be fixed unimaginably fast if they had to follow the same rules they expect us to live by.

I understand that congress will never impose this on themselves, so how do we the people make something like this a reality? Is there any way that either the states can do this with congress, or even we the people getting this put onto a national ballot?

I am sorry I am not an expert in constitutional law, but I know people here will have some answers.

Big order, involves the Congress, and every states legislatures.

Article V, or 5, in the US Constitution sets forth how to
amend the Constitution. There are 4 ways:
1. Proposal-- 2/3rds of each House of Congress and it is
ratified by 3/4ths of the State Legislatures.
2. Proposal--same as #1 2/3rds, each House of Congress
while ratification is done by 3/4ths of the State's holding
Constitutional Conventions.
3.Proposal --A Special Constitutional Convention is called
by Congress, at the request of 2/3rds of the states.
Ratification is done by 3/4ths of the State legislatures.
4. Proposal-- same as #3 while ratification is done by
3/4ths of the State Special Constitutional Conventions.

and another:

It would take a huge upheaval, to get a Constitutional Amendment Added. But I'm for it.

Absolutely essential.

Passing laws that apply to everyone but you is the height, if not the definition, of hypocrisy.

I'd ask how Congress can stand to look at themselves when they shave and/or put on their makeup each morning, but they probably get it done for free by peons.

It's not just Congress that's exempt, it's their aides, and staff..

Wouldn't do any good to ask....their heads are so far up in the clouds their own asses, they'd never be able to hear the question.

There.....Fixed it for myself.

Amend the individual states constitutions, it can't be overridden by Congress or the Supreme court.
Re- empower the sheriffs and arrest feds and prosecute them if they come in the state with state militias. Seceed.

Does the exemption go to the individual, or the "Office of" ?
If it's  "the Senator and his staff" then it only protects them while they hold the position, afterward you can go after them for indirectly related misconduct, look for money or property that the person has a hard time accounting for.
You may not be able to send them to prison but you can at least nickle and dime them to death with an unending string of court cases.

As I see it, the major problem to a Constitutional Convention is that everything is then in play.  We could lose the 2nd.  We could see the Federal Govt. obtain greater authority and power.  Heck, we could lose the entire Bill of Rights.  There may be some who say this could not happen because the majority would not stand for it...  But, with the Filthy Liar in the WH, there is no end to the potential for fraud and deceipt.

The immediate solution is to vote out every single one of the b@st@rds.  Congress needs to be reminded that they work for us and not the other way around.

I continue to weep for my country.
