17 News discovered a youtube video of Kern County Sheriff's Deputies and a bail bonds enforcement officer entering a local woman's home after she told them they couldn't come in without a warrant and her consent. With the evidence she caught on tape, the law seems to be on her side.
"I don't need a warrant," the bondsman said as he appeared to enter on his own into the home from a back door on the youtube video.
There were also sheriff's deputies at the front door. Deputies and bail bond enforcement officials have different laws but a local bail bondsman not affiliate with this case said what happened in this case was against the law.
"If you see the person go in, you can go in," Glenn Pierce, the owner of Gotta Go Bail Bonds said. "But you just can't go in randomly."
The woman who lived at the home told 17 News her name is Star. She said she is in hiding because threats were made against her. She also said deputies and the bail bondsman violated her rights by forcing entry into her home after she stated she was the only one there.
Attorney H.A. Sala says based on the video evidence, the Sheriff's Department could have a lawsuit on its hands because of the way they forced into the home without any knowledge of the wanted person being in the home. "They have to knock, state a purpose, say they have a warrant and give time for the person to surrender," Sala said.

I would agree, except for the video.....Now the Sheriff will have to explain. Bad Press. They will do what all good "political" office holders do, and throw them under the bus.

um, generally speaking bail bonds men do not need a warrent, as in the agreement for the bond you already give them permission. now the LEOs thats another matter.

TAB, my understanding of the bail bondsman (bounty hunter) is that he does not need a warrant to search the address you gave on your bond or if he sees you enter the house. Other wise he is just like any other LEO and must have a warrant to search.

In most states that is correct and if the bailbonds saw the person in the residence they can follow the fugitive into another persons home.
Rule 1 Don't get arrested in the first place.

Bail Bondsman jumped the gun, He saw NOTHING and NO ONE enter, Somehow got some bored LEO's to go with him to "take a look",...and effectively "Screwed Up".
If the LEO's were that concerned, a Search warrant could have been issued. The bondsman already had an Arrest warrant, but unless he sees the BG go in the house, he can't enter, without a Search warrant.
Plus the first Deputy, said he had a warrant, and than recanted, than said your gonna go to jail in about a second,,....."For What?"

They screwed up, and I hope they get smacked for it.

I agree,they should get smacked for it,that amounted to pretty much terrorism.Don't get me wrong,i'm pro law enforcement but abuse of power sticks in my craw.

Thanks. I really appriciate it. The filter is REALLY bizzare because it WILL block things as pornographic that isn't. They're pretty touchy up there about ANYTHING that is alittle too risque.

Move to Kentucky, they don't allow bail bondsman in the state
Bad news, you have to come up with the cash to get out of the jail.

Looks like they didn't find Allen in the residence, the bail enforcement agent had better be able to show that he had GOOD reason to believe that Allen was in there. As for the deputies they should have stayed outside of the house unless they them selves had sight of Allen inside there. Looks like this home owner has a good civil suite starting. When she asked them (the LEO's) to get out,with out warrant to search you are toast. Looks like these guys need to have a refresher course on government and the constitution. ???

He'll continue to lie. Hopefully the deputies will find a shred of decency or honor or self-respect and not back him up.

This does piss me off, just as advertised. The defendant may have given permission to search his home, but not mine. Even if I am his friend you better have a badge, a warant and a uniform if you kick my door in. As far as someone looking like "DAWG the Bounty Hunter" kicking my door in without a badge, well, he won't be there for that prayer service at the end of the show and I'll need a lawyer. Thing is though, I probably won't need a very good one as the Constitution, precedent and even Common Law are pretty clear about breaking into people's homes. Unless you have a warrant, are in hot pursuit or there are exigent circumstances, you just don't do it. Any badness that results is on you.
