Yep... I just got this in my e-mail from Gov Christie, I guess they took all of the e-mails on the subject and created a mailing list.

Please see below the signed commutation order for Brian Aitken, signed by Governor Christie at 4:30 pm today.
 
ORDER FOR COMMUTATION OF SENTENCE
 
WHEREAS, Brian D. Aitken was convicted of Possession of Dum-Dum
Bullets in the Fourth Degree in violation of N.J.S.A 2C:39-3(f)(l), Possession of
Large Capacity Ammunition Magazine in the Fourth Degree in violation of
N.J.S.A 2C:39-3(j), and Unlawful Possession of a Handgun in the Second
Degree in violation of N.J.S.A 2C:39-5(b) in the Superior Court, Law Division
(Criminal), Burlington County, New Jersey, and was sentenced on August 27,
2010 under Indictment No. 09-03-00217-1 to a seven-year term of imprisonment
with a three-year mandatory minimum; and
 
WHEREAS, the said Brian D. Aitken, caused to be made a written
application to the Governor for a Commutation of Sentence for the aforesaid
crimes of which he was convicted, and the State Parole Board, upon request of
the Governor in accordance with the law, has made an investigation of the facts
and circumstances concerning said application for a Commutation of Sentence;
 
NOW, THEREFORE, I, CHRIS CHRISTIE, Governor of the State of New
Jersey by virtue of the authority conferred upon me by the Constitution of New
Jersey and the statutes of this State, do hereby grant to the said Brian D. Aitken,
a commutation of the aforesaid sentence to time sewed, and satisfied on
December 20,2010.
 
IT IS FURTHER ORDERED, that Brian D. Aitken's release from the
custody of the New Jersey Department of Corrections be effected as soon as
administratively possible, or within a reasonable period to allow for release
processing pursuant to customary policy and procedure. ,
 
This Order is subject to revocation at any time, at the discretion of the
Governor, without notice.

Sounds like it, it wasn"t a pardon but just commuted to time served. he won't be able to own any guns. He can always try for a pardon later.

Barring any B.S. from "admin", the important thing is he'll be with his kids at Christmas. Perhaps the SAF, GOA, NRA, can petition the state for an exspungement of his record.

Important thing is, he's OUT.

He can live to fight another day, from the OUTSIDE...Preferably, the hell out of NJ. Thumbs up for Christie, good call.

While I agree that for him getting out of NJ would be nice I think that remembering why he was there is important also. It sounds to me that he moved from Colorado to NJ to be closer to his kids.

It's a good first step, but he needs to get it cleared from his record too.  Hopefully his support doesn't drop off before that happens.

By choosing commutation over a pardon, Christie just showed his lilly-liveredness.  Remember that when the GOP start talking about him as a Presidential candidate....

Hi;

     The conviction was a rush job and the media put the Gov on the spot, so a communtation of sentence will allow Brian the time (slowly ) to get everything made right so that his convition will be overturned and he gets his rights back as he should. This is going to take possibly years of legal stuff and the Gov did the right thing that will be approved by all in the long run.

     Just my .02

He should have never gone to trial. Now he'll spend the rest of his life battling the bureaucrats. As a convicted felon, I don't think he can actually leave New Jersey, can he? That is worse than prison time. At least in prison they HAVE to provide an lawyer. Now it'll come out of his pocket until his kids have to pay for the old folks home.

By not pardoning he allows the appeals to go forward in court. Higher courts can throw out verdict or law as unconsitutional.
Accepting the pardon means you accept guilt. No appeals possible.
Pardon can come later after courts are done with their say on the case.

If he was pardoned now, chances are he would be permanently on the NICS naughty list.  He has to fight .GOV as well as .gov

And he will see his kids outside of prison.  I doubt he is trash talking Cristie right about now.

He's fine as being able go where he wants. Its the same as it he served his sentence. The only downside is the loss of civil rights and the fact that he'll have to explain his conviction. Still, its a damn sight better than being in jail. The governor did the smart thing. A pardon opens cans of worms about policy and why this guys case was special. It would pick a fight with the legislature right off. Better to get the guy out of harms way and then deal with it later. Right now he's free and safe.
