ACLU sues the state over new immigration law

SALT LAKE CITY (ABC 4 News) – The ACLU is suing the state over a new immigration law.

Robert Archeleta is an American citizen worrying about what his life may be like in one week when a new state law goes into effect.

“If I am demonized because of the way I look, I can’t feel very comfortable, and I won’t.”

Many Hispanics like Archeleta wonder what their lives will be like when police have the right to stop them and ask for proof of citizenship, but the ACLU along with others is suing the state, asking the courts to step in, and wipe this law off the books.

“It leads to racial profiling and leads to officers making unwarranted arrests of individuals,” says Karen McCreary of the ACLU.

They also say the law is unconstitutional since immigration enforcement falls under the purview of the federal government.  Wayne Mccormack is a constitutional law professor at the University of Utah.  He says, for the ACLU, this case is not necessarily a slam dunk.

“The state is in fact right in what they are doing by applying their law to something that is already illegal under federal law.  That is a sensible argument.”

But, he says it may take more to convince a judge.  The ACLU contends the law is highly discriminatory, and will divert police officers away from solving serious crimes by turning them into immigration agents.  It’s the same point Salt Lake City Police Chief Chris Burbank spoke out about one year ago.

“As police officers we should profile criminal behavior, activity we can observe, that builds reasonable suspicion, that builds probable cause.  Tell me what is the reasonable suspicion of people in the country undocumented.”

More than likely what the eye beholds is the very thing concerning to Hispanics.

Since Americans of Hispanic descent are here legally, and are generally just as law abiding as any other ethnic group  their lives will be improved.
Their wages will go up since the will no longer be competing with illegals willing to work for less, their tax burden will go down because a higher percentage of the population will be paying taxes, same with the quality of public services . Auto insurance rates will go down since a higher percentage of drivers will have the, mostly , mandatory insurance , license and stickers for their vehicles, and for the older people , with illegal aliens removed from the Social Security rolls the may even get a COLA.
This doesn't even take into account lower crime rates and lower prison populations.

"Racial Profiling", and "stereotypes" exist because WHY???  Yessssss, THEY WORK!

Isn't it EVERY individuals responsibility to behave in a manner they WANT to be stereotyped as?  To "set the example"?

Forget that illegals are pouring over the border like a tsunami and are a huge drain on the economy and quality of life across the country.
It's all about feelings.  :'(   So sad...

That's why El Al is the safest airline in the world while TSA hasn't prevented squat.

Amen.

I have a nephew (by marriage....had to throw that in....  ;D ) that dresses and acts like the "street thug" stereotype and then wonders why security and LEO's are always giving him the eye.

Let's extend this argument a little.

So if a local LEO sees a bank robbery then because that's under purview of the federal government, they shouldn't respond?

If a local LEO sees a kidnapping in progress, they shouldn't respond, because that too is a federal crime?

Local LEO pulls speeder over and runs a "want & warrants"   If it comes back with federal charges he can't hold the suspect for the feds?   "Oh I see you're wanted on terrorism charges.  But that's a federal crime, so I can't hold you.  Drive safely now, ya hear."
