A WOMAN who impaled herself on a picket fence when she fell while urinating from an unprotected verandah has sued her former fiance for substantial damages.

In a Supreme Court writ, Michelle Egglestone of South Ballarat claims that the verandah at the house in Smythes Creek was constructed without any or with inadequate ballustrading and this caused her to fall a small distance to the star picket fence below.

Ms Egglestone, 35, sustained "penetrative injuries to the rectum, vagina and bladder necessitating surgical treatment involving laparotomy, repair of the bladder, repair of the vault of the vagina and colostomy'', according to her statement of claim.

"The plaintiff sustained injury at the premises whilst she was urinating from the verandah which was inadequately lit,'' it says.

She had sued Leslie Furness, saying that he failed to ensure the verandah complied with the building codes, failed to ensure the star pickets underneath had protective capping to minimise the risk of anyone "coming into contact with them''.

She said Mr Furness was the owner and occupier of the house and owed her a duty of care.

Ms Furness said the pelvic and lower abdominal injuries left her with scarring, depression and anxiety and post traumatic stress disorder and nightmares.

Her statement of claim says that her injuries while urinating were "a danger which could have been avoided with reasonable care on behalf of the defendant''.

Ms Egglestone says at the time of the incident on November 1, 2008 she was employed part-time by Val Pied shoes in Ballarat and lost income as a result of her injuries.

No defence has yet been filed.

dose it surprise you these days when people have to blame others for there stupidity and can not take responsibility for there own actions

anyone thinking this sounds  like a case of "how can I make him pay" than "he's actually at fault". seeings now he is an Ex....  ::)

Seems to me the only one to blame here is Sir Isaac Newton and those too stupid to heed his words of warning. Honestly, I would love to be opposing council. "So, you were drunk and pissing off the veranda as opposed to using the loo like a normal person, am I correct madam? And in the process of this disgraceful behavior, in the course of which you found yourself exposing yourself to all and sundry,  this unexpected thing known as gravity happened, dropping your fat arse onto the fence below. This is my client's fault why, you daft cow?" Just sayin'. ;)

Remember FQ, the woman who spilled hot coffee on herself and sued, won!  Some juries will go for any sob story!

For a defense I'd offer:

If there had been handrails, she would have had to climb up on them to answer Nature's Call and thus would have fallen farther and sustained more substantial injuries.

I will not counter sue for the damages my foresight prevented by minimizing the results of her stupidity.

You will note in the list of surgical repairs that they didn't fix her IQ.

Maybe you cant fix stupid, but you can jam a fence picket into it so it doesn't reproduce.  ;D

+1  And I am sure she was cold sober, probably broke up after he started laughing when she fell off.  I nominate for potential future Darwin Award winner.  ;D

Are you kidding? He's probably workingup  a drill based on this for his classes. "Ok guys, today we're going to focus on 360 degree situational awareness. You never know when some drunk chick is going to piss on you from balcony and then fall off. You have to learn to dodge. Remember, serpentine, serpentine!" ;D

My comment actually stemmed from a news story I saw a few years ago. I was sitting in a hospital waiting room keeping a friend company while a family member was having surgery. The TV in the waiting room was on some news channel and a story came on about a gardener somewhere in south Florida who was trimming a tree in a guy's yard and fell from the ladder, impaling himself through the rectum on a tree limb that eventually exited his upper thorax (he lived, with minimal damage, actually). My friend, who has a 'dry' sense of humor simply commented, "Took guts to do that.".......... I laughed and giggled off and on for the rest of the day.
