The foundation is the Constitutionality of DUI checkpoints and the right to NOT answer any questions......
But you better damn well be sober if you attempt this, and you may run into a real Gestapo Cop to ruin your night. ....technically, you have the right to say NOTHING....

What I think should happen to DUI's I'll never post on the internet so...

To clarify Dakota, I don't drink and drive!
My comment was that if there were a DUI checkpoint in my state, you'd answer the question or be arrested!
They don't give a damn about the Bill of Rights in Massachusetts anymore!

and that's fine. you will have no objection from me at all...However, for those that ARE sober, it comes down to the right to uphold one's Constitutional rights....
Drunk drivers won't be in the right mind to comprehend that....Too many videos/footage of intoxicated drivers that deserved it.
It's the chipping away of those rights to those that are truly NOT GUILTY...that bothers me...
One has to draw the line somewhere, and since I do not D&D, I will draw a line in the sand....In NC they can forcibly take your blood, if you refuse to blow,.all part of the "probable cause" blanket....they will take it anyway...easy or hard...
I won't surrender my rights that easily if I know I am in the right.

Pulling some one over for "suspected DUI" is Constitutional, swerving or other Fed up driving gives probable cause for a stop and a "breathalyzer, which is in effect a form of search.
Checkpoints are performing a search with out warrant or cause and are unconstitutional.
But the sheep go along, after all, "it's for the children.
