You Can Get Strip Searched for an Unpaid Parking Ticket: Thanks, U.S. Supreme Court

Bad news if you don’t like getting dehumanized: The U.S. Supreme Court just ruled 5-4 to OK strip searches for any offense.
What this means: if you get booked for an offense as minor as an unpaid parking ticket, you might have to bare all for corrections officers before being admitted to jail.
Yep, you read that right. Something as minor as an unpaid parking ticket can require that you suffer an immense indignity — including cavity searches — without having been convicted of any crime.
And jail officials don’t even have to suspect that you’re carrying contraband.
Justice Anthony M. Kennedy, who wrote the majority opinion, said that “every detainee who will be admitted to the general population may be required to undergo a close visual inspection while undressed” and that this does not violate Fourth Amendment prohibitions against illegal searches and seizure.
But the dissenting opinion decried the decision as disproportionately invasive.

I will point out that a while back (last winter ? ) there was a thread about a guy in jail who had been found with a revolver shoved up his ass, so maybe this isn't so unreasonable.

The introduction of weapons and contraband into the correctional environment is an extremely serious problem. It places everyone's lives at risk... offenders as well as staff. You would be amazed at the items that can "fit" in various places - folding knives, cell phones, batteries, ammunition, small guns, drugs, etc. Here in Texas, back in the latter part of 2009, a 500-pound man concealed a gun in his fat folds - and IIRC he had been searched twice before it was discovered.
If you work in corrections or have loved ones that do then maintaining a safe working environment is at the top of everyone's list. Unfortunately, however, that isn't always possible.

I second this. My best friend's dad is a guard at Oak Park Heights, a level 5 SuperMax, and he tells us absolutely incredible stories of the things they find on (er, I mean 'in') prisoners. It seems that some of the prisoners have nothing short of an army duffle bag for an anal cavity.

In the book "Papillon" the guy who supposedly escaped from Devil's Island tells about keeping all his valuables in a tube stuffed up his butt the way you or I would put a wallet in our pocket.

How bout an X-Ray, (or better yet, an MRI).. The first would answer the question and the second would provide the answer.. As for the latter, just make sure it's a soundproof room with a floor drain and a bottle of bleach handy..
(He said he wasn't hiding anything. We had no reason to doubt this word. The MRI was just protocol..)
If you pulled that for about 6 months, the attempts might slow down just a little.

Sorry, the analogy is BS. Strip searching a felon entering for a stretch or hard time is hardly comparable to busting drunken Aunt Sally for public intoxication or DWI.
Common sense just ain't common any more. And .gov intrusion - literally in this case - just keeps getting worse.

I have to disagree here Path.
If Aunt Sally is going into the jail, even the drunk tank, it is the same thing.
I don't really see a problem with it as a standard part of booking .

Part of this might be us citizens fault in a litigation happy society...
As soon as you are in custody, the police are responsible for your safety, or so someone will try to prove, so if Aunt Sally harms herself with anything but her fingernails, some lawyer will get a family member to file suit.
If she hurts someone else, there will likely be two families with lawyers.

Well, I guess it could be a matter of perspective. If I'm a correctional officer, risking my life each day serving the people of my community or state, then I think it IS common sense to take steps to ensure that I get to go home to my wife and kids at the end of shift.
I already have to worry about homemade shanks, toothbrushes with embedded razor blades, shoestring garrotes, disease-ridden feces and glass shard mixtures or hot oil being thrown in my face, etc. The kinds of weapons that I face each shift is limited only by the offender's imagination - and they have a LOT of time to be imaginative. And this is what I have to look forward to while being unarmed and outnumbered 30 to 1. So if a good ol' butt check will keep poor Aunt Sally from smuggling in something else that can kill me then I say it IS common sense to do it... and so does my wife and my kids.
Like I said, maybe it's just a matter of perspective.

I'm of 2 minds on this, on one hand, Prisoners have to damned many "rights".
People in jail have already shown a disregard for the rules of civilized behavior, they should not benifit from a social contract they have already violated.
On the other hand we all know some badge heavy prick would abuse the authority.

Failure to appear or a fugative from justice. Is not a small thing. Unpaid ticket could be one or both. When I worked for a ffl, I saw more dmv ( unpaid tickets) then doj kick backs.

And reason #42 why you will never get my vote for much of anything. You have become way too complacent with the high crimes and misdemeanors committed by all levels of .gov these days, all in the names of safety/security/children/policy/reason du jeur.

See above re safety. The rights of the citizen cannot and should not be abridged because you believe you have some sacrosanct right no one else has to go home safe at the end of the day.
I'm touchy on this specific point, since I had a county sheriff deputy LEO, a field training officer no less, use the same excuse. I had asked, in a semi-public forum, what the reaction would be if during a traffic stop I mentioned I had a CCW and I was carrying. This is a law in some states, but not here in ND. The FTO responded he would order me out of the car, cuff me (proning me out in the process if he felt it necessary) and disarm me - for his own protection. Seems he too wanted to go home safe at the end of the day.
The ND State Constitution, paragraph 1 of Section 1 of Article 1, in fact, enumerates very clearly that residents have a right to carry. Yet the FTO was willing to violate that enumerated right so he can feel safe. And, to worsen things, he stated that if sued, there isn't a jury in the county who would convict him.
Wasn't that the same excuse used by cops in the deep south when they routinely violated the rights of black citizens in the 20's, 30's 40's, etc.? ? ?
No shrug on this one. If you're afraid, change jobs. DO NOT VIOLATE ME OR MY RIGHTS!

I'm pretty sure that everyone who visits this forum on a regular basis feels the same way about their rights and ANY attempt to abridge those rights. So let's put that issue aside first... I don't want my rights, your rights, or anyone's rights violated or abused. Secondly, while I've never worked as a correctional officer, I spent several years as a contract educator inside a federal correctional facility. I've seen first-hand the type of senseless brutality and horrifying savagery that these officers face each day. It takes a special kind of courage to "walk the yard" unarmed and outnumbered... I appreciate the job they do and I'm thankful that there are men and women willing to do it.
The last distinction I want to make is that the SCOTUS ruling has to do with "detainees" - these are folks who have ALREADY BEEN ARRESTED for violating the law and are being processed for admission to the correctional facility. This isn't about police stops on the street.
