A bill which would change California law on CCW,
effectively making the state "Shall Issue" and removing the
arbitrary discretion of Sheriffs to withhold permits for
political reasons, AB 357, has been referred to the Public
Safety Committee. Please call and tell these people to VOTE
YES for AB 357.
California - AB 357 - Call Now and urge to vote YES
BILL NUMBER: AB 357 INTRODUCED
BILL TEXT
INTRODUCED BY Assembly Member Knight
FEBRUARY 19, 2009
An act to amend Section 12050 of the Penal Code,
relating to firearms.
LEGISLATIVE COUNSEL'S DIGEST
AB 357, as introduced, Knight. Firearms: license to
carry concealed firearm.
Existing law authorizes the sheriff of a county, upon
proof that the person applying is of good moral
character, that good cause exists, and that the person
applying satisfies any one of certain conditions, as
specified, to issue a license for the person to carry a
concealed handgun, as specified.
This bill would delete the good cause requirement, and
require the sheriff to issue the license if the other
criteria described above are met.
By imposing additional duties on local law enforcement
agencies, this bill would impose a state-mandated local
program.
The California Constitution requires the state to
reimburse local agencies and school districts for certain
costs mandated by the state. Statutory provisions
establish procedures for making that reimbursement.
This bill would provide that, if the Commission on
State Mandates determines that the bill contains costs
mandated by the state, reimbursement for those costs
shall be made pursuant to these statutory provisions.
The Shall Issue bill, AB 357, has been referred to the
Public Safety Committee. Please call and tell these people
to VOTE YES for AB 357.

old news... The good thing( if it passes) that will come from this is it will make a list of what will DQ you.
It will take either a series of court cases or another bill passed to make it standardised.
Edit, I would not be shocked at all if the CA DOJ uses this to form a policy that is even more restrictive...

I thought that lady Sheriff in Orange County, is trying to revoke the CCW permits issued? Saw it recently.
-
With the way that state is run. I don't think any Pro gun laws have a chance of being passed. It might as well be run by France! :(
-
Or the NSDAP. >:(

You have to show cuase for that, its much easier and political safer just to not renew them. Which is what she is doing.

The way I understand it is she is not just not renewing them. She is telling them if they don't "voluntary" accept early expiration, then she will revoke them effective 30 March 2008, and you will have a negative mark on your file for having your CCW revoked. She is doing this to about 400 people that she feels should not have them for whatever arbritary reason she decides, and is even using her henchmen (deputy sheriffs) and questionable tactics to harass legiimate protestors. This situation is COMMIEFORNIA at it's best.

Can't do that in CA with out showing cuase,( unlike issuing CCW, there are very strick rules about removing one)
its one of those lawsuits that can't be won... she either has to show cuase or she can't touch it. She is trying to scare people into giving them up.
They come up for renewal every 3 years. Thats how I lost mine, moved less then a mile, crossed county lines... the sheriff would not renew it. No reason was given.( they don't have too) Then again The sacramento county sheriffs are useless... but the sheriff has managed to give out CCW to his biz partners... even though they are federally prohibated from owning firearms... ::) Yeah I feel safe. in sacramento county, if you need a LEO, you just hope your in one the 3 fallowing citys.
1 sacramento
2 Rancho Cordova( new city, these guys don't mess around)
3 Citrus Hieghts ( same as Cordova, new city, they don't mess around)
All of the unecorperated areas in the county that have a large enough tax base have split from sac county.

Tab, I'm by no means an expert on CCW or Ca. law, but as I understand they are doing it. Please visit this site for more info: http://www.usconcealedcarry.org/news/newsletter/disarmed-power-hungry-sheriff-ignores-pleas-of-citizens/ If this info is inaccurate or wrong, in any way, I apologize. But according to all the research that I've done, this IS happening.

As I said, she is trying to get people to turn them in, she can't take them with out cuase. She legally has done nothing wrong, yet.
Now on to that link... unless you tell them that you have a CCW revoked, there is no way of them knowing that ( legally) even a life scan( the system used by all the schools, most goverment agencys, and any employer that was a deep crimal back ground check) ran by that DOJ can not give out that info)
While yes a revoked or denied CCW will stay on record with the DOJ... once again you can not remove a CCW with out cuase( basicly you commited crime(s) or have a restrianing order against you.), which is highly regulated. Also, in CA, all of the sheriff dept know who will and who will not issue CCWs. So in CA that black mark really means shit. If they did it for a valid reason that would be stored with the DOJ and would DQ anyways.

No, this is my County and she's giving the choice of early expiration or revocation. Many of my friends have gotten their letters. Her causes are that she says they were political favors for supporting former Sheriff Carona, who may be sentenced soon and that causes that were inline are no longer.

Thats a intresting argument, if she can prove it, she can legally revoke them.
-
If this happening I hope someone calls the NRA. I would think they would spring for the lawyer just to get the ink (and subsequent funraising fodder). It truly is amazing what a certified demand letter from an attorney can do to get a public official's undivded attention. Unless they're willing to cowboy up (for publicity reasons of their own) the odds are they'll just figure its easier to let it go away rather than have to deal with it. I mean it may be California, but its still Orange County, you can't swing a sharply dresed chihuaua without hitting a`republican

The NRA has been sending lawyers to all of the Board of Supervisors meetings. She just brings in her plain clothes SWAT officers to harass the people who support concealed carry and she spies on the Supervisors. This an appointed Sheriff that was placed by the Supervisors, because of Sheriff Carona's legal troubles. Hopefully, someone else will be elected next year. The biggest problem isn't the Sheriffs like her, it is the law that allows them to treat us as subjects.

The sad reality is, there is nothing that any one can do to stop her from pulling them( short of getting her removed... not going to happen unless they find something really bad or the public speaks out, once again not going to happen.) After the fact they can rip her a new one if she can't prove cuase for revoking them. I'd be really intrested in how she can prove that they were political favors.
Short of a paper trail or a wittness I don't see her being able too.
-
This one's got a slim chance, but let's keep our fingers crossed.

Nice to see that your local paper is pro-2A (he said sarcastically)
A hearing Nov.18 brought a crowd of angry gun activists to the Santa Ana boardroom, where they spent hours defending their perceived right to bear arms.

Yep! And supposedly, this is the flagship paper of the Libertarian party. ???
