so I'm going over the statement I got from our gas card. 

one of the cards has 2 transactions on it for ~ 16 gallons of 87 octane, for each transaction... only prob with that, the card holder drives a diesel box truck, we have never done work near that station, its right next too his house and they are both on days that he did not work.

how dumb can you be?  Your making several bucks more then the going rate, have a easy job, drive a brand spanking new truck( as in less then 15k miles and 3 months old) and 99% of the time your home.

PS anyone have a CDL with hazmat, thats looking for a job? Placing the add on CL now, I bet by the time I get up in the morning I'll have atleast 100 resumes, by wed most likly 500.

If the guy otherwise does a decent job, it might be easier to keep him on and make restitution than deal with the hassle and uncertainty of wading through those 100 resumes. Not apologizing for the guy, but petty theft versus not showing up, showing up drunk, liability issues etc.? Its worth thinking about.

theft will always get you a pinkslip.  way too many people hungry for work.

besides, chances are very good I'll get some one that is already working for some one else that wants more $ or is sick of being out of town..  Thats how I've gotton just about all my employees.  Its extremely common in the constrction industry.

I'd be shocked if don't have someone by friday.    If push comes to shove I still have my cdl with hazmat, so I could drive the truck.   I think I would rather do that then what I've been doing latly, which is a mound of paper work( office manger is about ready to pop, she is having twin girls.)

I agree with TAB on canning this guy, It would be one thing if he got caught short and needed to fill up to get to work.
In that case TAB should have found out about it when the guy came to reimburse him.
But the average gas tank is 10 gallons, so he may be filling up the wifes car as well.
And it's getting to be a habit.

16 ish gallons is a fill up from "E" on most mid-large sized cars. 

If he needed it to get to work, I'd have just filled up his car.  All he had to do was come to me and ask, in case of emergency( like wallet gets lost/stolen or cards stop working) give me a call.  it would have been NP.    Twice in month is either he is stealing or some one stole his card.    be greatful I'm not pressing charges,  if some one else used his card illegally, I will be pressing charges.

Theft is theft.

I agree with you on the moral issue, I was just focusing on the hazmat issue with the CDL. As a general rule I'd rather have an honest idiot than a competent thief. But when the honest idiot could put me out of business with a lawsuit, and the thief will do the job right and he knows not to steal again? I'll reconsider.

This thief wasn't very competent either.

Fire him for being a thief or fire him for being so stupid to do steal in a way he could not miss getting caught...or fire him for both..no redeeming qualities.

I know a man who preferred Nixon as president over Carter because he said he would rather have an smart thief running the country than an honest idiot.

He also was a strong supporter of BHO, so maybe his evaluations don't count for much.

Get rid of him and dock him for the 100 bucks you lost out of his last paycheck.  Make sure you document why you garnished a bit of his pay.

And maybe his wife grabbed the wrong card to fill her tank.  You should at least hear his side of the the story before you just can his ass.  Maybe he is a thief who deserves to be fired.  Maybe there is a reasonable explanation and you are about to screw someone because you are jumping to conclusions.  YMMV

Good point Ichiban but personally, I don't let my wife anywhere near my wallet or credit cards.  She has her own even though I pay her bills!

I have found a philosophy during my studies that successful companies employ, "Hire for attitude, train for skill."

It works in lower skill areas and can be effective when interviewing a group of skilled individuals.

Trust is a fragile thing.  You are trusted until proven otherwise, after that you have a HUGE hole to dig yourself out of and it takes time.  Pink slip would be my course of action as well.

All of this will do three things:
1.  Help keep him from receiving unemployment benefits that come out of your pocket;
2.  Keep him from filing a legal claim against you for unpaid wages;
3.  Put the incident in to the legal system.  This is good because in this age you can not tell future employers what he did, but if they do a background check it will show up.

Being an employer can really suck.  Especially when you hire idiots!

Good points, all!  Having never employed anyone, I hadn't considered this...

Edit  I will add this as pertains to CT unemployment compensation.  If you're terminated without cause it's either a short term or permanent layoff and therefor eligible to benefits.  If you're fired for no other reason than the boss "didn't like your vibe" than you will more than likely win your case with the state arbitrator.

If you're terminated for CAUSE, such as theft or other justifiable circumstances then you're pooched.

and just what kind of construction business is this that you have to have a CDL + HAZMAT?

and where are you located?

I had a boss once...he was so tight he squeaked.  He was looking to cut corners every chance he got, and in the process violate regs.

Anywhooo...he relayed a story to me once about how he had a coffee cup filled quarters sitting on his desk.  on top he had say like 4, one dollar bills.

then he noticed one day that two or three of the dollar bills were missing.

so he calls out one of his employees about it, figures it is him, and then fires him.

now this is the kicker...that has me still shaking my head after so many years working for the guy....the boss said, "I didn't fire him because he stole from me.  I fired him because he was dumb about it.  He should have just taken the money in quarters instead and I would have never noticed it."

 ???

a few years ago, I noticed the old boss's equipment up for sale on Craig's List.  He had gone out of business.  I had a good laugh when I saw that.

Anywhoooo....since this forum seems so hip on protecting the 2nd Amendment....how about a little love for the 6th Amendment....ya, know, the one that says you have the right to face your accusers/witnesses.

Have a meeting with him inside your office in private and show him the statement from the gas card, and tell him what you think happened.

See what his reaction is.  Within 30 seconds you'll know if it was done maliciously with intent to steal/defraud.

And you'll know at least it was done man to man.

If you had paid attention you would be aware that TAB deals in house painting and some remodeling.  Commercial vehicles used in construction, and HazMat due to paints and associated items and the lead mitigation he is involved in.  This business is in California, so he deals with unreal regulations.

Sixth Amendment - This is private business and not a public setting.  His employee has a credit card and misused it.  If it were a emergency situation the employee has had time to contact TAB.

I can't speak to TAB's generosity or tightness, but the stupidity of the employee says it all.

* I can't believe I am spending this much time helping and defending TAB  ???  Will someone please just shoot me!

We don't deal much with the credit card codes around here.  That does put it in a different light.

Sounds like he has entitlement issues as well.  Now he has time to go hangout with the Occupy Whatever crowd.

Tyler,  A comment like "How would you feel if I stole 50 bucks off of you?" would have put TAB in trouble in many states.  In fact, in many stated he went too far with the comment about filing charges.  I refer back to the comments I made on a written notice and keeping your mouth shut.  That comes from attorneys (I actually just sat in a session on just that thing last Thursday), and is not something I pulled out of a posterior orifice.

its a gray area here.

In a perfect world, I would have taken it out of his last check, but I can't do that.

If I really wanted to screw the guy, I would have waited for it to get over a total of $400.  That way it would have been a felony. then gone to the DA, and had him arrested on "the clock".  Thats not me, and frankly its not worth my time.


Reality is, the point was made to the rest of the employees that theft will not be tolerated, I got rid of a theft.  Its win win on my part.


as of 11:50 am this morning, I have almost 200 filled out apps and resumes for the position.   Out of the 1st 50s of so I've gone thru only 2 were from guys that didn't meet the job reqs.

Good call TAB, everyone HATES a thief. Especially one with a job, and part of the "crew". He's lucky, were not as civilized as those other countries, where we would have "cut" something off to remind him...

More likely his wife is kicking him in the ass.  Any throw away interviews to break it up?  You know, like American Idol, keep one unqualified person to laugh at to break up the routine  ;D
