Knife rights still in jeopardy?
« on: August 01, 2009, 06:43:14 AM »
Hello and good day, I have contacted my Congressional Representative – Bill Posey along with Senator Mel Martinez (R) and Bill Nelson (D)- all of Florida- concerning the challenge of the U.S. Customs toward folding knives, assisted opening knives, etc.  He sent back this response which leads me to believe they are pushing forward with this and have tucked language into the Homeland Security Appropriations Act of 2010;

Thank you for contacting me with your concerns about the regulation of knives.

As you may know the possession, sale or manufacturing of a switchblade knife is carefully regulated in this country by the Federal Switchblade Act of 1958, under Title 15 of the United States Code (USC). In response to recent discussion about re-interpreting that code more widely, the Senate unanimously passed an amendment to H.R. 2892, the Department of Homeland Security Appropriations Act for 2010, with the intent to clarify some of the language of the Federal Switchblade Act.

The amendment would add language to 15 USC Section 1244 to include “a knife that contains a spring, detent, or other mechanism designed to create a bias toward closure of the blade and that requires exertion applied to the blade by hand, wrist, or arm to overcome the bias toward closure to assist in opening the knife.” H.R. 2892, the Department of Homeland Security Appropriations Act has been passed by both the House and Senate, and is currently in conference.

You can be sure that I will keep your thoughts in mind as this issue is considered by the Senate. I appreciate your letter. Your communications helps me serve you better.

Sincerely,
Senator Bill Nelson

I can be a bit slow at times but it sounds to me like they are moving forward with their intentions and have circumvented the public once again, wanted to let someone know that could do something about it.  I will post this on three other forums to get the word out.

If someone knows that this has been stopped please respond to this post so I don't spread bad information around the net.

Thanks,

We're currently in the 'wait' phase. BFAT has said they'll wait until the senate amendment works it's way through the conference and is or isn't included in the final bill and made into law.  This will happen after congress gets back from the AUG recess.
