Same down here. Here is the sad thing. In the name of being "tough on crime " legislatures stripped discretion away from the judiciary. They came up with BS like mandatory minimums, letting juvies be tried as adults, and three strikes laws and the like. The trouble is they let that authority move from judges who are either elected or confirmed by those who are, to unelected bureaucrats in the DA's office who answer to no one. Worse, these idiots get promoted on their win/loss record. They see themselves as trial advocates for the victims, not neutral magistrates interested in the truth, even though the legislature made that their job. They just won't understand the difference between can and should. This kid is screwed.

No, the reason they did it was because they wanted to campaign as being "tough on crime", as opposed to being smart on crime. Think I'm lying? I'll give you proof. In 1986 the US Congress did two things. first they endorsed the recommendations of the US Sentencing Commission which they had established to standardize federal sentences. Basically, it set a default maximum and minimum sentence which could be added to or subtracted from based on aggravating factors(like using a gun), or mitigating factors (like cooperation) etc. However, that same year they passed mandatory minimum sentences to fight "the war on drugs" which negated their careful work in setting up the sentencing commission? Why? Because Len Bias died of a coke overdose and Tip O'Neill wasn't going to let Ronald Reagan out drug war him in a by election when the Celtics great black hope was lying dead. It really did come down to something as petty as a first round pick for the Celtics dying that caused  the fact thousands of people are rotting in jail. Sorry Tom, but the record is against you here. The reason judges aren't allowed to, you know, judge, is because politicians want to be Sheriff Joe and brag about how tough they are. That's nice, and its cute, and if you're 12 years old you find it amusing. But the US Constitution has Article III that promises an independent judiciary and I don't like politicians messing with that.

Which would you rather do:  Pine for this poor little boy sitting in prison for life because of a mistake in his mid teens, or explain how he slipped through the system and lead another youth down the path to violent crime five years from now?  There are far too many news stories, news stories used by freedom destroying activists daily, every year concerning liberal feel good social workers that made sure a fifteen year old threat that was released from the system and grew into a deadly threat preying on whole communities.

I'm not the father of a teenage daughter.  She is well into her 20's and headed for 30's.  Seriously, If you can't do the time, don't do the crime!  Just like every other parent in the world, I am always just one phone call away from my perfect child being a statistic.  We all accept it, and responsible parents hold their children to the highest standards possible.  I wouldn't want to see it happen, but even more so, I wouldn't want them to go down the wrong path.
