If someone get's killed it will be manslaughter on the caller's part and a failure to confirm the call should put massive liability on the policing agency.



I do believe a felony, which this type of false report should be, that results in death is considered murder.  Premeditated would be pretty easy to prove as well.

As for the PD, as long as they acted in good faith I think it would be hard to pin anything on them. 

This is were having a good relationship with local PD, or at least an officer or two, should be part of our overall plan.  I mean most of us have a plan for the "zombie apocalypse" or EOTWAWKI shouldn't we cultivate some relationship with local PDs?

I posed the situation to my nieces husband, a SWAT guy turned SWAT Trainer in a small city in the area, and asked if the caller couldn't be charges with Murder, had it gone down that way. He said that Criminal Mischief and making the caller pay for the cost of deploying the SWAT Team was all that could be charged against him, as "Intent" would be near impossible to prove..
He brushed it off..
I followed that up with that White Paper from Cato about all the wrong addresses, that I posted somewhere here.. http://www.cato.org/pubs/wtpapers/balko_whitepaper_2006.pdf and he replied that he didn't pay attention to those sorts of things, but just "developed his craft"..
I have yet to have a Cop treat any of these things seriously.. I know "why".. I just wonder if they would all be as dismissive or passe' about the tactics employed against those not demonstrated to be "in need" of such treatment if it were their own wives and children in danger of being shot to death in their own beds..
And my merely suggesting this would immediately incour the ire and wrath of the same LEOs so dismissive of the practice on somebody else..

Sounds to me like a few of these SWAT guys need to have it happen to them.
Law Enforcement in general are the enemies of the people by the fact that they are governments muscle.
Their job, and general attitude makes them no different than Mafia leg breakers.

Interesting that in Indiana, the homeowner could get away with defending himself against the unlawful entry of the SWAT Team, (see new Ind. law post),....That is of course, if they survived the gunshots.....Incoming fire has right of way.
