O your right their, especially when you earn your living with a gun! A few years ago we had a commanders call on the subject, cause it prevents you from serving in 99% of the military occupations! Had to fill out a form attesting to not having any DV convictions. I don't even think you can be a cook or a chaplains assistant with a DV conviction! :-[

Billt is right, just like getting robbed, avoidance is the best defense strategy.
 I don't doubt TAB's stories either, My ex wife's Uncle, while getting divorced and running for Mayor (at the same time) Was accused by his ex of molesting one of his daughters, despite evidence to his innocence (The prosecutor was a political opponent )
He went to prison, as far as I know he is still there. (This by the way happened in NH, not Ca. )

On the new 4473 forms it asks (Yes No) If you've ever been Charged with a misdemeanor domestic violence charge. It also asks if you have a restraining order against you. Yes on either question, no gun for you. What is really bad is in several states if someone calls the police and claims domestic violence, and the police show up, someone is going to jail! No matter if the charge is just or not. In many divorce cases the wifes attorney will automatically get a restraining order just to make the husband look like a bad guy, and of course to jack up his fee. It takes a couple of minutes to file for one, and they charge several hundred dollars for it. It is almost as if they are looking for any way to permanently destroy a citizens right to own a firearm.  Bill T.


That very thing happened to my brother.
Took a lot of $$ for the divorce and to get the charges vacated (judge found no proof in the end) and over a year for him to get my grandfather's 60's era High Standard (the only gun he owns) back from the sheriff's impound.

Total BS the way the system can be played.

A long time ago in a galaxy far, far away, during my divorce, her "friends" gave her advice to gain leverage over me. Drum up a totally BS "restraining order" because she was afraid, and I owned guns.

The problem was, I ran the Marina where the County Sheriff's kept the Lake Enforcement Boats, and often brought prisoners from the County Jail to clean, wash, wax the patrol boats. Over the years I knew these Deputies on a first name basis, even had some to my house for BBQ, and beer (off-duty).  I almost became an Iredell County Sheriff. Was () that close.

When I was served at work, Deputy "Jeff" said this was the biggest bunch of crap he has ever seen, but had to enforce the order.
He would follow me home to gather some clothes, etc,...at the end of the day.

At home, I told Jeff to take my guns as I was afraid the soon to be ex would pawn them, he actually knew the wife, me, and let me take them! Told me to lay low, go to work, and go to court. He than offered to testify on my behalf.

When the court day came, her lawyer wanted this and that, and couch, and TV, and etc,.... I told him to "F" off until this BS restraining order was rescinded. As I had 3 Deputies ready to testify on my behalf, he quickly talked the ex into dropping the order. Benefits of a small town. But during that 10 days she emptied the house and moved out. Except for my guitars, and a couple of other things that was it.

She didn;t get my guns though,...except for a Davis .380 I bought for her for $99.00 :-\

Your right Peg, if it wasn;t for the Deputies that I knew, I may have been totally screwed. I was still screwed from the divorce but not as badly... :)

He graduated with the deputies that took him in and they both said it was a BS play, but had to follow their court order.

He got it all straight and took care of, it just cost a lot of $$'s.

She's still being a PITA by using the kids....screwing with visitations and skirting just this side of contempt of court with the judge. He's been in court a half dozen times this year just to see his kids. New judge (female) just came into the picture, though, and has put her foot down and said "enough-is-enough" because she can see through the ex's BS.

You reckon its tough over there, here if some one threatens you and you take out a court order (agrevated violence order) then you still lose your firearms and firearms licence as a matter of course. It is then up the the police commissioners determination if your licence is reinstated and your firearms returned.
Like wise if some one takes one out on you (requires no burdon of proof mind you) which is often the case in marital disputes where a partner is vindictive then you also loose you firearms and licence, if the report is found to be false and you are cleared then you still have to apply for your licence etc
