The Japanese boat should have yeilded the right of way by the rules of the road.  Size matters but, as a vessel motoring in the open waters you are obliged to allow vessels on your starboard side to cross.\

 Check your COLREGS International Regulations for Preventing Collisions at Sea 1972 Adopted and amended in 1977, 1981, 1989.
Rule 7(d)(i) "danger bearing" "Determining Risk Of Collision" (OBTW, they crossed in front of the whaler), in a deliberate provoking maneuver. Throws the give way thing out....

The whaler was clearly the "stand-on vessel" as the punk ass eco boys intercepted her course, changed her course and bearing several times, and in essence was buzzing the whaler as she was faster and more maneuverable.

Also general right of way provisions, pertain to commercial fishing vessels, vessels NUC (not under command or under tow), vessels under sail, or work vessels with restricted manuevering.

Plus there is the 22.5 degree rule abaft... There is also the Danger Bearing for even a give way vessel that the eco punks violated.

The rules of the road went out the door, The whaler also gave "five blasts" to avoid collision. Your Inland Waters & Great Lakes regs are sound but don't apply to International Waters.

Check your Chapmans, I have. Plus common sense says don't play chicken with a larger vessel. They did, and they lost.

The Officers on the whaler will have beers bought for them back in port.

But it may not matter as the eco-boys are now claiming the ramming was an "act of piracy on the high seas."  I don't follow their logic, but I only have 15+ years as a licensed captain and a few hundred thousand miles under my keel, so maybe they know some law I haven't run across.  When the eco-boys deliberately changed course, they made themselves the give-way vessel and had every duty to GTH outta the way.  That's how a maritime court should see it.  But, I have stopped believing in the logic of political bodies.

While it has been ten years since my mates license expired.  I will stand by the my original statemet.  I'm comfortable in this because my next statement was that the eco-freaks also had a duty to avoid the collision and did not.

  22.5 abaft the beam, Colregs, Stand-on vessel, I had to look up which side the green was on ;D

I will definitely differ to those still doing the job. 

These guys tried everything to make the whaler the give-way vessel.  That is why they are trying to say that they were a victim.  Again, I believe these guys were ultimately in the wrong.  Didn't really mean to start a tomato/tomahto thing, especially when I'm carrying cabbage.  Just pointed out what I thought I REMEMBERED.

as was mentioned earlier, Chapman's is a good book for learning rules of the road. easy to read and very informative. and I'm sure that there's nothing in there that would justify the green weenies and their actions. they were in the wrong. above everything else when reading the rules/laws etc.... is 'do everything possible to avoid collision', these clowns provoked it.

Wonder what would happen if I get my green laser sight and lit them up coming up the river? Muahhhhh
Better still on both sides of the derwent river is the remains of the old fortifications, including old cannons, a pound of black and a 5 minute fuse would give me enough time to get to a good vantage point and watch the fun unfold!
