US judge says Guantanamo prisoner should be released

WASHINGTON — A US federal judge has ruled that a Mauritanian accused of links to the 9/11 attacks should be released from the US prison camp at Guantanamo Bay, Cuba, the court said Tuesday.

In a two line decision posted on the court's website, Judge James Robertson ruled in favor of Mohammmed Oul Slahi's habeas corpus challenge to his detention at the prison on a US naval base in Cuba.

The judge said an explanation of his decision would be made public once it has been declassified by US intelligence services.

Slahi filed the habeas corpus request, which he wrote out by hand in English, to a federal court in the US capital in March 2005.

The Bush administration claimed that Slahi, an imam in Hamburg, Germany after returning from Afghanistan in 1992, was a member of the so-called "Hamburg cell" linked to the September 11, 2001 attacks.


In his filing, Slahi said he handed himself in to Mauritanian authorities after the September 11 terror strikes.

"My government extradited me eventually to the US and since then I am being detained in GTMO, Cuba," he wrote in part.

Despite the accusations against him Slahi was never tried in a military court.

"I have done no crimes against the US nor did the US charge me with crimes, thus, I am filing for my immediate release," he also wrote.

It was the 34th time a US federal judge has granted habeas corpus to a Guantanamo detainee since the Supreme Court made it possible for detainees to contest their detention in civilian courts.

In 1999, Slahi was well known to U.S. and German intelligence officials, although they did not know he was in Germany at the time, according to the 9/11 report.

He was approached by a few individuals interested in fighting in Chechnya, including two of the hijackers on September 11, and Ramzi Binalshibh, the roommate of a third hijacker, Mohamed Atta, the report said.


Instead, Slahi recommended they go to Afghanistan for training. They took his advice, met various al Qaeda members there and the plot began to take shape, the report said, citing intelligence and interrogations.

A Fox news terror analyst, said this morning, we could send him back to Mauritania, (his homeland), where he would very likely be welcomed with open arms, and taken right to the gallows.

This just wasn't your average pee on, he knew Atta, and the others that flew the planes, he recruited them, and others, while operating the Hamburg cell. This Judge seeing fit to grant him anything besides bread and water, or a firing squad, is astonishing.
