State Sen. Spencer Coggs (D-Milwaukee) and Rep. Tony Staskunas (D-West Allis) are the principal authors of the legislation, which received public hearings in both the Senate and Assembly this past week.

The bill would essentially require all firearm transfers to be conducted through a federally licensed firearms dealer, except transfers to family members, law enforcement and military agencies.

I think that this is a good idea, but it shouldn't need to be a law. I have always had my dealer run a check before I sell someone a gun. The only exception is close friends with a CCW. I do it simply to eliminate my liability if some whack job tries to buy a gun from me.

JC,

It is fine if you want to and choose to go to an FFL to handle the transfer for you, but is should not be the law.  When I do a private sale I use a bill of sale and put their driver's license number on it.  If it is someone I don't know I have a regular FFL for that I have them fill out and sign.  I do this anytime I let others use my guns during a class or just at the range, if I don't know them.  This way if there is a legal issue I have done my part (as advised and explained by my attorney).

The last thing we want is the gov. getting more and more wedges in the cracks until they topple the entire tower!

My concern would be as a seller, I sell "x" to John, than John goes and commits crimes, he is caught with the gun he bought from me, the LEO's run the serial numbers, they come back to ME as the original owner.

Now than, am I now in trouble?

As long as you were in compliance with the law yourself and operated in good faith you may have to testify at his trial but you do not bear any legal burden.
That is from personal experience, a local store owner bought a pistol from me years ago then got arrested for cashing stolen food stamps . What I did not know was that before moving up here he had served 2 sentences for armed robbery.
When ATF came to ask me why I sold it to him I pointed out that Felons could not get a liquor licenses either but he had one prominently displayed and cases full of beer.
Turns out the beer license was in his ex wife's name but the fact that I had considered that cleared me of any wrong doing.

Selling guns= bad...


I don't have a prob with it going thru a ffl, as long as there is no cost and it takes 5 mins.
I always break all the clay pigeons,  some times its even with lead.

What do you meen "Selling guns=bad..."?

You know that if you go through an ffl it will cost you money - I don't know of any that doesn't charge ... except my friends that do it for a little beer or steak from me ... ooooops, that costs; and you should know from experience that it will take more than five minutes - figure ten minutes for you to transfer, and ten minutes for the buyer to transfer, plus any other delays or BS.

As I said earlier - This is just another wedge being placed in a crack until the entire Second Amendment crumbles!  Please try to view this through some other glasses than the Kalifornia tinted lenses you are accustomed to.

Exactly. Like I said, I run a check and do a formal transfer simply for my own reasons. I know I don't have to, and I think it should remain MY CHOICE. The only real reason I can see someone wanting to make it illegal to do a private sale of guns is simply so the government can collect more tax revenue. Once they make it law that you have to transfer through an FFL they can then start taxing that transaction.
It would be like selling a car. You bought it and paid the taxes on it, but then when you sell it, the guy that buys it has to pay sales tax on it all over again.  ???  I don't know why they need a V.A.T. They already tax everything as many times as they possibly can.   >:(

That would not be a problem except it would never be free...... If its a govt run, you can bet your ass they are gonna find some way - or 3 - to tax it.

And like noted earlier, its not about keeping guns out of the hands of criminals. Its about adding another level of control for guns in general.
