(Obama) Administration halts prosecution of alleged USS Cole bomber

The Obama administration has shelved the planned prosecution of Abd al-Rahim al-Nashiri, the alleged coordinator of the Oct. 2000 suicide attack on the USS Cole in Yemen, according to a court filing.

The decision at least temporarily scuttles what was supposed to be the signature trial of a major al-Qaeda figure  under a reformed system of military commissions. And it comes practically on the eve of the 10th anniversary of the attack, which killed 17 sailors and wounded dozens when a boat packed with explosives ripped a hole in the side of the warship in the port of Aden.

In a filing this week in the U.S. Court of Appeals for the District of Columbia, the Justice Department said that "no charges are either pending or contemplated with respect to al-Nashiri in the near future."

The statement, tucked into a motion to dismiss a petition by Nashiri's attorneys, suggests that the prospect of further military trials for detainees held at Guantanamo Bay, Cuba, has all but ground to a halt, much as the administration's plan to try the accused plotters of the Sept. 11, 2001, attacks in federal court has stalled.

The losses were restricted to military members.  Those lives don't matter.  It's not like it was some asshat Harvard professor, or a 60's radical/terrorist that got killed.

Seems the blind sheik in the WTC 93 attacks is wasting taxdollars in at least prison. I would have preferred the death penalty, but alas....

Pelosi wants fast investigations of "whose funding the opposition" to the Ground Zero Mosque....

I will actually (sort of) defend BO here. He gets crap from the right first for wanting to try these guys in federal court. Now he gets it for not doing so? Which is it? Regardless, something has to be done. We can't just indefinately detain people on suspcion. That's not how things work. BO and the military and Justice Department need to figure this out one way or another. Or we could just stop taking prisoners all toghther unless we absolutely had too (gee, there's an idea).

PS as to the speedy trial bit? Most defendants wave that right so they can prepare a defense. Once you do that though, it can be a while before you see a jury. 10 years is beyond pushing it though.

I'll accept that as a mitigating circumstance as soon as BHO makes the statement that the Republicans were right all along and he was wrong to go for a civilian trial and will now do it their why like I should have from the start.

Actually we can. Put the kool-aid down FQ. These are not American citizens, and they are not criminals. These are enemy combatants, captured on a battlefield, from countries all over the world. Namely Egypt, Suadi, Syria, and Iran. Most of them captured in either Iraq or Afghanistan. So basically they have no rights. Other than basic human rights afforded to them by the Geneva Convention, which is questionable since Geneva really doesn't have rules for terrorists who wear no uniform and have no loyalty to any country. Although we, in all of our insane compassion treat them better than we do our own soldiers. Most of these guys should have never been detained. (some multiple times) They should have been interrogated on the battlefield and summarily shot when the CIA was done with them.
