They get sued all the time. For everything from gross negligence, and abuse to destruction of property. Most of these never make it to a courtroom because it is less expensive for the municipalities to settle out of court, or because the plaintiff is a hack and lacks the evidence to present a case.
Yes there are some limitations to suing police, but you can still sue. If you couldn't then cops could run roughshot over everyone with no repercussions.
There is no distinction between governmental workers here, cops or the DMV. You can sue if they break the law or written policy. If however, they just do a piss poor job, they (meaning the state) are covered. Essentially, brutality, corruption, failing to follow SOP is grounds for a suit, though the latter is iffy. If on the other hand, the guy just acted like a total Gomer, checked the boxes and moved on, there isn't much you can do. In the first case I mentioned where the case worker falsified reports, that's criminal negligence and fraud, lawsuits are fine. Here, where the guy showed up at the door and just took the woman's word that the kids were asleep? I hope he can be charged and sued, but odds are he, and worst of all his department, can't be. Sometimes 8 figure jury verdicts are a good thing. They tend to motivate people. Forcing FL. to pay out in this case, even though it will come out of my wallet, would be a good thing if it made the Governor clean house to prevent a reccurence. The squeky wheel gets the grease. This one should squeak very loudly indeed.
