California "Dream Act" approved for illegal immigrants

LOS ANGELES (Reuters) - California Governor Jerry Brown signed into law on Monday a bill allowing illegal immigrants to receive privately funded scholarships to attend the state's public colleges and universities.

The bill, dubbed the California Dream Act, passed the state Legislature earlier this month and aims at helping illegal immigrants who have earned a high school diploma after attending at least three years of high school in the state.

"At the end of the day, if we're going to continue as a powerful, equal-opportunity society, we're going to have to invest in our people," Brown, a Democrat, said at the signing ceremony in the library of a Los Angeles community college.

The state law is named after a national bill introduced in Congress last year to give young, undocumented immigrants who have lived in the United States for at least five years a path to citizenship through college or military service.

The federal bill failed to win passage in December 2010, and its chances have dimmed since a Republican majority took control of the House of Representatives this year.

Critics say the California Dream Act gives illegal immigrants a false promise, because their immigration status will not change after graduating from college, and they will remain unable to find legal employment.

The new law merely makes undocumented students who qualify eligible for private scholarships. Many are unable to otherwise afford more than a two-year degree from a community college.

A separate bill under consideration in the legislature would allow illegal immigrants to qualify for publicly funded scholarships as well.

State law already allows illegal immigrants in California who qualify for admission to a four-year state university to pay in-state tuition rather than the more expensive out-of-state tuition rate.

But four-year institutions are still beyond reach for many undocumented students without financial aid.

Twelve other states also grant in-state tuition eligibility to illegal immigrants based on attendance and graduation from a state high school, according to the National Conference of State Legislatures.

Arizona, Colorado, Georgia, South Carolina and Indiana bar illegal immigrants from in-state tuition benefits.

What frosts me about this bill and so many others is that they actually refer to these criminals and fugitives from justice as "illegal immigrants."  The are illegal, they are breaking the law, they are stealing from law abiding citizens and legal residents of this nation!

HARTFORD, Conn. -- This will be the first year that illegal immigrant Maria Praeli can consider going to college fulltime.

She and her family had feared that the cost would be more than they could afford. But the 18-year-old high school student can now qualify for in-state tuition at Connecticut's public universities under a law that took effect last week.

A ceremonial bill signing was planned for Thursday afternoon.

The law can reduce tuition costs by as much as $17,000 annually for undocumented students such as Praeli, a rising senior at New Milford High School who is plans to apply to state schools.

"It gives me something to work for," said Praeli, a native of Peru who was taken to the United States when she was 5 years old. "It's easier to see your future."

Connecticut is now among 12 states, including New York and Illinois, that grant in-state tuition to illegal immigrants who are working toward legal status. Advocates also have been pushing for a federal law providing a path to legalization for qualified illegal immigrant students and other young adults, but the federal legislation known as the DREAM Act has failed repeatedly in Washington.

Fewer than 50 illegal immigrants are expected to take advantage of the new law immediately, with the University of Connecticut expecting less than 10 for its next term. But advocates say that number could rise to 250 across Connecticut within the year as enrollment increases at community colleges in particular.

Lawmakers who supported the tuition change say it makes sense to give students who were raised as Americans a chance to succeed. Opponents say it is unfair to legal residents who could lose a spot in the in-state pool because of the new law.

The law requires the undocumented students to attend four years of high school in Connecticut and then file a statement with their college or university saying they will apply for legal residency when eligible to do so. Currently, if an illegal resident applies for lawful status they are subject to deportation.

Any and all supporters of these state laws are criminals, violating the law and their oath of office.

True. But remember this cuts both ways. This what opponents of  Arizona and Georgia's laws are arguing, that immimgration is a federal issue. There's a lot of hypocrisy here. Still I think we have a much better case asour side is about the state's enforcing federal law, not flouting it.
FQ13 who would love to see an ICE official note that they will supoena the admissions applications to find illegal students. That would end it quickly.

There is no comparison.
States like Ariz. and Ga. are filling a void created by the federal Govt refusing to enforce their own law. They have no problem with State or local authorities  executing warrant's on tax charges. The NH couple who made news a few years ago as tax protesters were arrested by State cops, but their local taxes were paid, there were no state charges against them. It was purely federal.
These other however, are engaging in a conspiracy to violate federal law. That is a felony.

FQ - Section 8 tells us who at the federal level is responsible for immigration.  However, it does not forbid any lower jurisdiction from having their own as long as they do not infringe on any Rights.

As far as California's new law - This law breaks federal immigration laws, which means that it is unconstitutional.
