SO INSTEAD OF HAVING MY WIFE GO, I GO. SO AFTER A WHILE, WE GO TO COURT,(BOTH OF US) & THE JUDGE(WHO HAPPENS TO BE THE JOP WHO MARRIED US & OUR OLDEST DAUGHTER!) SAYS GET COUNSELING & I DON'T WANT TO SEE YOU GUYS AGAIN. SO WE SEE COUNSELORS & THAT WAS WAS THE LAST I EVER HEARD OF IT UNTIL NOV. 2011.
What did you answer to question
i: Have you been convicted in any court of a misdemeanor crime of domestic violence??
Did you plead or were found guilty?
It sounds like you were, if you were ordered to go to counseling
unless the completion of counseling was in lieu of a guilty verdict.
THEY TELL ME IT IS STILL ON MY RECORD & ALWAYS HAS BEEN!!??!!?? NOT TRUE, I SAY UNTIL 3 OR 4 MONTHS AGO.
How did you determine that it
wasn't on your record until 3-4 months ago?
Criminal records do not "go away" (pardons, expunged convictions & restored rights are different) even if the court itself only keeps the records for 10 years. Go to the county/state and do a record search on yourself. They probably transfer the records to a storage facility so they don't have to build a new wing just to hold boxes and computers. You will probably need to go there.
If you were given the go ahead on a previous NCIC check, that doesn't mean the record doesn't exist, it just didn't raise the flag at that time.
And yes, you REALLY need to hire an attorney. You might also send a thank you note to
that prick Senator Frank Lautenberg for the domestic violence provision on gun ownership, but that would probably put you on yet another "list".
Do a search for Form 4473 and read Exception 1 and Definition 4.
