Who Cannot Have a Gun in America?

Just for the record:



The Gun Control Act of 1968 prohibits certain people from possessing a firearm.There are nine categories of persons prohibited from possessing firearms under the Gun Control Act:

        * Persons under indictment for, or convicted of, any crime punishable by imprisonment for a term exceeding on year;
        * Fugitives from justice;
        * Persons who are unlawful users of, or addicted to, any controlled substance;
        * Persons who have been declared by a court as mental defectives or have been committed to a mental institution;
        * Illegal aliens, or aliens who were admitted to the United States under a nonimmigrant visa;
        * Persons who have been dishonorably discharged from the Armed Forces;
        * Persons who have renounced their United States citizenship;
        * Persons subject to certain types of restraining orders; and
        * Persons who have been convicted of a misdemeanor crime of domestic violence.

Safe to say, that if Barack Hussein Muhammed Obama gets elected that this list will include a lot more folks.

My only disagreement with the list relates to misdemeanor domestic violence convictions being a lifetime ban. Political grandstanding in my opinion. There should also be a process, other than the unwieldy and politicaly sensitive Presidential Pardon, to "earn a restoration" of lost rights for Federal felons. That being said, the penalty for possession of a gun or ammo by somebody on the list should be a mandatory 10 years. Warehouse them in Cuba until the word gets out.

I agree with Ron J. I also feel that laws should stay either where they are now or only change for the BETTER! I can say this because I live in a state (KS) that has few regulations and we just got class 3 laws passed. That wont change a thing for me since I have no desire to pay for the machine guns or licencing fees. Plus having a CCH I finally feel at least this state has a good (not perfect) grip on how firearms shouls be regulated. I cannot comment on returning freedoms to the reformed but I can gurantee if my life took a turn for the worst and I had to make a home of the Grey Bar Motel I would definately want my rights back!

It will be easier to list those that can have a gun if he (or she) gets in ... NO ONE!

One law that Kansas has I hate is that I can not buy a gun there.  They have a short list of states you can live in and buy there, and I don't live in one.  I tell ya, when the family stuff gets old and I take a trip to the "store," it really irritates me when I come across a deal and can't do it!

This varries from state to state... in many cases( like in CA, but other states as well)  if a Doctor thinks your a risk to yourself and others then can put you on a 3 day hold  5152 which means for the next 5 years you can not own a gun... or if 3 doctors think your a risk to self or others they can place a 3 day hold on you that is 5150... in that case your skrewed for life.


Recently my great uncle was placed on a 5150... now this guy is 87, on methadone for pain, has colon cancers, can't walk... I think you get the point.    Anyways colapsing, and spending 16 hours in a ER, in withdrawl from his methadone and in pain... he said " just let me die"  So he spent 3 days in the LA county mental health system...( which helped him alot I'm sure  ::) )   he is now prohibated from owning fire arms and the 2 he had are now in my safe since he can not pocess them.   

I always break all the clay pigeons,  some times its even with lead.

I wonder if OB trips up as (if he becomes) President we can get the courts to take away his keys to the nukes?
