Will The Gun Control Fillibuster Work ?
« on: April 09, 2013, 08:40:19 AM »
Rand Paul and about a dozen or more other Senators are threatening a filibuster of any new gun legislation. I don't understand how doing this will require a 60 vote majority? If anyone understands how this political process works, please educate me here. The news always reports on these things, but they never explain them. How does, what amounts to talking your ass off, make the bill require another 10 votes to pass??  ???

A filibuster in the United States Senate usually refers to any dilatory or obstructive tactics used to prevent a measure from being brought to a vote. The most common form of filibuster occurs when a senator attempts to delay or entirely prevent a vote on a bill by extending the debate on the measure, but other dilatory tactics exist. The rules permit a senator, or a series of senators, to speak for as long as they wish and on any topic they choose, unless "three-fifths of the Senators duly chosen and sworn"[1] (usually 60 out of 100 senators) brings debate to a close by invoking cloture under Senate Rule XXII.

So, correct me if I'm wrong. It requires a 60 vote majority to end the filibuster to get to the voting process, not to pass the legislation in question? Is this the same thing Rand Paul did just a few weeks ago?

That's about it. A fillibuster has two meanings. One is the good old fashoined stand up and read the phone book till you pass out model (think Jimmy Stewart or Strom Thurmond). Once you have the floor its yours till you yield or can no longer stand at the podium.

The other is about the cloture vote. The Senate rules can allow any member to object to a bill being voted on. At that point it requires 60 votes to agree to vote on the bill in question. Its a good provision as the Senate was designed (with its longer terms and staggered elections) to be a buffer against populist nonsense like these gun bills.

They could just read mine on the floor of Congress and hold things up for several hours.

I never send political statements that can not be backed by either the Constitution or the Supreme Court.
The Miller decision says they can take Joe Biden's shotgun, but not our AR's.
