The judge already told the defense that Waters comments are grounds for appeal  Joe just makes it solid.

Verdict is in,

If he is convicted it could only be on the 2nd degree manslaughter  charges.  Anything else it does not meet the legal requirements.  The other side of that is I know the judge would immediately grant an appeal based on other factors of this trial.
