CA CCW Shall Issue Legislation

A  bill which would change California law on CCW,
effectively making the state "Shall Issue" and removing the
arbitrary discretion of Sheriffs to withhold permits for
political reasons, AB 357, has been referred to the Public
Safety Committee. Please call and tell these people to VOTE
YES for AB 357.

  FEBRUARY 19, 2009

  An act to amend Section 12050 of the Penal Code,
  relating to firearms.

  LEGISLATIVE COUNSEL'S DIGEST

  AB 357, as introduced, Knight. Firearms: license to
  carry concealed firearm.

  Existing law authorizes the sheriff of a county, upon
  proof that the person applying is of good moral
  character, that good cause exists, and that the person
  applying satisfies any one of certain conditions, as
  specified, to issue a license for the person to carry a
  concealed handgun, as specified.

  This bill would delete the good cause requirement, and
  require the sheriff to issue the license if the other
  criteria described above are met.

  By imposing additional duties on local law enforcement
  agencies, this bill would impose a state-mandated local
  program.

  The California Constitution requires the state to
  reimburse local agencies and school districts for certain
  costs mandated by the state. Statutory provisions
  establish procedures for making that reimbursement.

  This bill would provide that, if the Commission on
  State Mandates determines that the bill contains costs
  mandated by the state, reimbursement for those costs
  shall be made pursuant to these statutory provisions.

The Shall Issue bill, AB 357, has been referred to the
Public Safety Committee. Please call and tell these people

old news... The good thing( if it passes) that will come from this is it will make a list of what will DQ you.

It will take either a series of court cases or another bill passed to make it standardised.



Edit, I would not be shocked at all if the CA DOJ uses this to form a policy that is even more restrictive...

I thought that lady Sheriff in Orange County, is trying to revoke the CCW permits issued? Saw it recently.

With the way that state is run. I don't think any Pro gun laws have a chance of being passed. It might as well be run by France! :(

You have to show cuase for that, its much easier and political safer just to not renew them.  Which is what she is doing.

The way I understand it is she is not just not renewing them. She is telling them if they don't "voluntary" accept early expiration, then she will revoke them effective 30 March 2008, and you will have a negative mark on your file for having your CCW revoked. She is doing this to about 400 people that she feels should not have them for whatever arbritary reason she decides, and is even using her henchmen (deputy sheriffs) and questionable tactics to harass legiimate protestors. This situation is COMMIEFORNIA at it's best.

Can't do that in CA with out showing cuase,( unlike issuing CCW, there are very strick rules about removing one)

its one of those lawsuits that can't be won... she either has to show cuase or she can't touch it.  She is trying to scare people into giving them up.

They come up for renewal every 3 years.   Thats how I lost mine, moved less then a mile, crossed county lines... the sheriff would not renew it.  No reason was given.( they don't have too)  Then again The sacramento county sheriffs are useless... but the sheriff has managed to give out CCW to his biz partners... even though they are federally prohibated from owning firearms...  ::)   Yeah I feel safe.  in sacramento county, if you need a LEO, you just hope your in one the 3 fallowing citys.

1 sacramento
2 Rancho Cordova( new city, these guys don't mess around)
3 Citrus Hieghts ( same as Cordova, new city, they don't mess around)

All of the unecorperated areas in the county that have a large enough tax base have split from sac county.

But according to all the research that I've done, this IS happening.
