concealed carry question
« on: May 22, 2009, 04:14:25 PM »
I'm a new member here and love it so far.

Anyway, I finally received my card for conceiled carry this last January.  Looking over the rules, the one that says "b. Any space occupied by state or federal employees" got my attention.  A hardware store that I frequent several times a week has a counter in the back of the store that has a lady that I assume works for the Post Office as she sells stamps, weighs and accept packages, does everything a Post Office does except there are no Post Office boxes for rent.  The way I read this is the 'space' she 'occupies' is behind her counter and not the whole store.  There is no sign at the entrance of the store that disallows conceal carry.

What is the opinion of those here?  Forgot to mention, I live in NC.

Alot of places offer those services in retail, they take the packages and the post office comes by once a day and picks them up.  From what you say I doubt that they are employees of the government.

Check to see if there is a small sign that says stuff that is not allowed in PO, Usually has Pictures. or just ask the Lady. Sounds like a small enough town that you will get a straight answer with out hassle.

DeltaM,

Welcome!

All federal property is generally off limits such as post offices, federal buildings, courthouses, etc....

Recent legislation will allow concealed carry in National Parks that reverts to the States provisions for carry.  It's not law yet though, the President has yet to sign it.  The hardware store is probably private property with a convienience window for these types of supplies as we have them in supermarkets in the east.

Check with the owner of the store without revealing the reasons why your asking.

I would agree with the above posts, BUT do check. Because if the absolute worst possible thing does happen, eg a shooting with collateral damage, the last thing you want is  a ready made federal charge there in front of the DA. Personally, if the postal worker can't clear it up, I'd leave my gun in the car when I went inside.

MB has mentioned this several times with very good advise.  Spend a little bit of $ and speak with a lawyer familiar with the CCW laws in your state.

In FL there are several areas that have shades of gray, like a restaurant that serves alcohol.  Depending where you are and the circumstances surrounding your visit to the area should dictate your carry decision.
The person who has nothing for which his is willing to fight, nothing which is more important than his own personal safety is a miserable creature and has no chance of being free unless made and kept so by the exertions of better men than himself.

From a federal law stand point, your fine.

state laws may differ.

FWIW  don't bring a gun ( unless your mailing it) onto post office property( yes that inculdes the parking lot)  doing so is a federal felony.  The USPS investagtions unit has the highest conviction rate of all federal agencys,  they also make the ATF and the IRS look nice.

Hello DeltaM, Welcome to the DRTV forum, as a former 20 year resident of NC, Charlotte, Mooresville, Hampstead, Oak Island, Carolina Beach, and Wilmington, yes I moved quite a bit for a while.

The Hardware Store is private property, the lady who sells stamps, is more than likely a "contractor" for the Postal Service and not a Federal employee. Never a bad idea to just ask,...The County Sheriff has the discretion to set the local/county regs on CCW.  Here lies the rub, not just in NC but in a few other states. Some county regs. contradict State Law, and the that;s the way it is.

No CCW at a funeral for example...(Only in NC)....

Here's one better, look up the open carry statutes in NC (it is legal), BUT they wonderful "gray area" can get you a "brandishing to the terror of the public".

NC is great that way.  Sometimes the less they know the better but, I always would just ask.

Pender County towards Burgaw was about the worst.

Former long time NC resident,

Thomas Jefferson: The strongest reason for the people to keep and bear arms is, as a last resort, to protect themselves against the tyranny of government. That is why our masters in Washington are so anxious to disarm us. They are not afraid of criminals. They are afraid of a populace which cannot be subdued by tyrants."
Col. Jeff Cooper.
