Go a little easy on lawyers.  Afterall it's only about 99% of them that give the rest a bad name.

having meet several lawyers over the years( both in court and as a client)  I have yet to come accross a scum bag lawyer... greedy, yes, ambulance chaser no.  Lots of complete idiots...

I also, hate insurance companies. You basically pay the bills to be legal on your car or mortgage, but if you need to actually collect, good luck. Commercial is worse. However, TAB, if your beef is personal, not commercial, there is a partial exception. USAA. It insures only military, current or former, but your coast guard service should quailify you. They are a non-profit (a co-op) and their rates are as good or better than Geico, and they pay claims quickly, with no penalty. If you are eligible, I would check them out.

I will never, ever be a USAA member.  period.  

got hit by one of thier members a few years back,100% thier fualt. had to sue to get them pay me...  They have a huge office here, after 3 months of getting the run around( ca law says you have 60 days to either fix the car or pay up, after that all you have to do is you show up in court and they ow you 5k+ lawyer fees and what they ow you.), not able to talk to any one, I went there to talk to the person,  they would not let me talk to her face to face, on office  phone, I then asked for the CEOs contact info, they would not give me that.  10 am the next morning they were served, 2 pm I had a check for about 25x what my claim would have cost them.  if I wanted to wait I could have made that 100x more.  I was done dealing with it.

what cracks me up is I told them from day 1, write me a $500 check, I'd have signed a waver and walked away.  It was really very minor damage.  So in the end I got a check for about 13k, my lawyer got one for about 2 grand, and I bought the truck back for $200, went to the junk yard, pulled a fender that was the same color, and put 50k more miles on the turck.  

Damn I wish I could get another USAA member to hit me again...

PS USAA, like all insurance companies, takes the legal decision making out of your hands the second a claim is filed. It's their call, not yours, as its their  nickel, not yours  at stake.Negotiate seperatley, and you void your coverage. Blame the company, not the member, for the hassel.

my walk away number was $15k.  I could have hit them for close to 100k by the time you add every thing up if I wanted.


edit from your edit... actually in CA, if they had not have payed, I could have went after the driver.  I didn't as it was not his fualt, but I could have served him at the same time. I didn't as it was not his fualt... totaled out thier brand new honda van that was only like 2 weeks old.    God I love heavy old american trucks.
