Actually, my thoughts, are this opinion by this court (if it sticks and upheld by the Supreme Court) could lead to great changes for our freedom.

I do not think it will be appealed.  The reason is simple.  The Left does not want to risk the Supreme Court ruling that the the 2nd  Amendment is an idividual right.  To uphold this Appeals Court ruling the Supremes would do just that.

Further, I do not think the Supremes will take the case if it is appealed.

Should it be appealed and the Supremes take the case and uphold the Appeal, the results would impact many, many state and local laws as well as some federal laws.  This would be good for our side.  BUT, if the appeal is struck down the Left will attack the rights of the individual at every turn.  It would set the stage for the loss of private gun ownership.

This ruling will no doubt be scorned by politicians and gun grabbers as a tool to let "blood run in the streets."
I hope they get a clue and realize the blood and bad guys are already there. At least now the law abiding citizen has chance of surviving their day.

Sarah, the Boxstein twins and UpChucky will be hammering this ruling in the MSM.
When the rulings favor making criminals of all of us, they are "sound."  When the rulings favor personal freedom they are "misguided" and "out of touch."

All in all, pretty damn good day isn't it?   ;D  ;D  ;D

I think the second line is most likely - the USSC will not take the appeal. Better to let the Appellates overturn a small jurisdiction, which can then be re-voted into existence by DC, than to go the whole 9 yards and overturn all of the anti-gun laws.

On the other hand, if things are really more controlled than any of us think and/or want, then the USSC will take it, will overturn the Appellate decision, and let the gun grabbers go nuts on us locally, which is better than calling out the Army on all of us en masse. That would be bad for PR, don't you know.

I'm hoping it's the former, but this is an excellent day.

I don't know if it will be appealed to the USSC but if it is I think they will take it.  It goes to the very heart of the 2A which is why the USSC exists, to clear up what is meant by the Constitution.  If they don't they will mightily embarrass themselves and greatly diminish the importance of the USSC.

The DC case is about the right of the individual vis a vie the 2A.  The court would hear it but how they will decide is of course, open for debate. The current adimistration has said through the AG that they consider the 2A to be an individual right having nothing to do with a militia.

The USSC has not heard a 2A case in 70 years - so it is unlikely.

And the AG who made that comment was the former AG, not the wussy current one.

So what does this mean then? Nothing until and if the SC rules? Could the larger body of the Appellate court overrule this?

Obviously the mayor of D.C. was irked, but is that because he is afraid that the crime rate will go down and that could mean less dollars for him? Myabe less reliance on the local government?

I know very little about Constitutional law.

The Appellate can overrule the decision, but in practice it generally doesn't.

I heard Paul Helmke from Brady on NPR, and they're in hysterics, hoping that the ruling does not get appealed at all.

Remember, the Ninth and the Fifth Circuits are in direct opposition, and the D.C. Circuit ruling only adds to the issue...which generally means that sooner or later the Supremes are going to have to step up to the microphone.

I think this is an important moment!

I just don't see the supremes taking this case. They dont like to mess with the second amendment usually, and they will run away from this one. If the next court doesnt mess with the ruling and the supremes won't hear it, I have to think it might hurt the Chicago gun bans as well as possibly SF and NYC?
