There is no liability for the business owner. Its the same as if someone had a car accident in a mall parking lot. Does the mall have any liability because they own the property? No. Should businesses also not allow cars on their property? Statistically, it is a far greater risk then guns.
so if you have a ND and injure one of my staff, It won't be a claim to my workmens comp, and I won't have to deal with OSHA?
Federal law states if they spend more then 24 hours at the docs, OSHA does a full inspection. it does not matter if its a paper cut and the guy spends 24 hours in the waiting room or a massive accident that sends several people to the ICU for days/weeks.
Like it or not my if he is on the clock, workmens comp covers it, atleast up front. Just like Car insurance if you have a claim, rather your at fualt or not, your policy goes up. now the comp company will go after the guy, but how many people do you know that have say 1 mil just laying around that they could pay for a ND? what about 100k? 100k is not alot for a medical bill.
actually, you might be liable if some one has a wreck in your parking lot. That has more to do with you not doing something you should have.
