That's where you are wrong, by remaining on the Res they retain their status as "Free Nations" they ARE NOT US Citizens. The large number of Indians who have served in the US Armed Forces , ALL volunteered, Indian's can't be drafted .
There is no requirement to remain on the Res. which with out Gambling, are usually little better than refugee camps, But if they leave they lose their Allotment.
Just like they did with the land its self, they are selling their rights to KEEP the boot on their neck.
But since you are so fixed on the obscure case, I assume you know squat about a visionary who witnessed the Custer battle as a young boy.
"Black Elk Speaks", I forget the Author or publisher, Some one else can supply them, I KNOW MB has read it  ;D
Dee Brown did not write the WHOLE story, also read "Lame Deer, Seeker of visions "
Until 1920, they didn't have the option of leaving. This was what Black Elk attempted to do. He basically said "Screw it, enough of this. I'll take my chances in the white man's world and assimilate as a citizen". He was denied that right. A man born in this country was denied the right to be a citizen that was granted to a fresh off the boat European immigrant. To me that is shameful, and its why I am annoyed by this case. As for folks choosing to stay onn the res, well, that's their call as sad as it may be. It doesn't change the fact that Court could have ended the nonsence  by applying the 14A as it was written.

Dude, This is where you are off track. He was NOT "Born in this country", He was born in a FREE Lakota Nation, he was no more an American than some one born in Quebec.
The original purpose of the Res. were as concentration points for Enemy combatants and their families, they were in fact big POW cages.
He sued in the 20's ?
The last recorded Indian raid was in Az. in 1931.

You seem to know a lot about the case.
If you knew anything about the Man, you would realize that much of the Foolishness you spout as "Libertarian", is what led to the black road.

Dee Brown wrote "Bury My Heart at Wounded Knee". John Neihardt wrote "Black Elk Speaks".
Had both for years. Good books, but with some controversy as to the telling of Black Elk's story.

Because the book shows John Neihardt as the author of the book and not just the editor, there has been controversy in academic circles and native circles, significantly that of Indiana University professor Raymond DeMallie, as to the accuracy of the story from Black Elk's point of view. To make this book, Black Elk spoke to his son who translated the story into English for John Neihardt and his daughter to record. The primary argument made by DeMallie and others is that Neihardt, being the author and editor, was able to exaggerate or change some parts of the story and did so to make the story more palatable and marketable to a white audience in the 1930s.

Outside of a few "real" questions, which she was so well coached on, and BS'd her answer,....Just like Sotomayor, who said during her confirmation circus, that the 2nd Amend and Heller are established law, what was her position this week on McDonald?

Liked the question about that teenager movie "New Moon", and the love fest between the Libs and Kagan.....

She's a progressive/liberal rubber stamp of BHO, and we all know it.

Thomas Jefferson: The strongest reason for the people to keep and bear arms is, as a last resort, to protect themselves against the tyranny of government. That is why our masters in Washington are so anxious to disarm us. They are not afraid of criminals. They are afraid of a populace which cannot be subdued by tyrants."

Minnesota should be proud.

I can't discuss it due to the black 'copters and such  >:(

By the way ... Have I ever mentioned the way our wonderful liberal state handed him the seat in the most illegal games of any recount ever had?

Thanks for screwing my blood pressure up another 192 points  >:(  Again  >:(

Sorry Peg, I phrased that badly.  It should have been more like, Dee Brown did not tell the whole story of the indians, Black Elk and "Lame Deer, Seeker of visions " tells another side of the story.

Thanks for coming up with John Neihardt's name     ;D
