That's where you are wrong, by remaining on the Res they retain their status as "Free Nations" they ARE NOT US Citizens. The large number of Indians who have served in the US Armed Forces , ALL volunteered, Indian's can't be drafted .
There is no requirement to remain on the Res. which with out Gambling, are usually little better than refugee camps, But if they leave they lose their Allotment.
Just like they did with the land its self, they are selling their rights to KEEP the boot on their neck.
But since you are so fixed on the obscure case, I assume you know squat about a visionary who witnessed the Custer battle as a young boy.

As for folks choosing to stay onn the res, well, that's their call as sad as it may be. It doesn't change the fact that Court could have ended the nonsence  by applying the 14A as it was written.

Dude, This is where you are off track. He was NOT "Born in this country", He was born in a FREE Lakota Nation, he was no more an American than some one born in Quebec.
The original purpose of the Res. were as concentration points for Enemy combatants and their families, they were in fact big POW cages.
He sued in the 20's ?
 The last recorded Indian raid was in Az. in 1931.

You seem to know a lot about the case.

Dee Brown wrote "Bury My Heart at Wounded Knee". John Neihardt wrote "Black Elk Speaks".
Had both for years. Good books, but with some controversy as to the telling of Black Elk's story.

Because the book shows John Neihardt as the author of the book and not just the editor, there has been controversy in academic circles and native circles, significantly that of Indiana University professor Raymond DeMallie, as to the accuracy of the story from Black Elk's point of view. To make this book, Black Elk spoke to his son who translated the story into English for John Neihardt and his daughter to record. The primary argument made by DeMallie and others is that Neihardt, being the author and editor, was able to exaggerate or change some parts of the story and did so to make the story more palatable and marketable to a white audience in the 1930s.
