A confident NO is the right answer, stammered BS indicates it needs more work, we'll reschedule for next week. For SC nominees,, there is no rescheduling.

Its a classic, and a black eye to the Constitution. "Domestic dependent nations" indeed. A fancy way of saying you have no rights because we say so. Kind of like declaring an American citizen an "enemy combatent". Nice try, but no. If we defend the Comnstitution, we live by it. If we think we can put it away when it suits our purposes? Well, get off my obstacle Pyle!

But you are missing the point about  "Domestic dependent nations".
You are looking at it in 21st century context of  Everyone is equal blah blah blah.
It takes on a different look when you remember that few Americans would have had any qualms about exterminating the entire race of "savages". When you listen to the whining from these dole moochers, you think it might not have been such a bad Idea. By the way, that only applied to those who chose to stay on the Res. Not to those who decided to assimilate and get JOBS.

But I was referring to Black Elk himself.

My take on "Black Elk" is this: All those born or naturalized. What part of this did the Court fail to understand? The whole reservation system and the BIA should have been thrown out. You're all American citizens, here's some land you own collectively, deal with it as you will.

That's where you are wrong, by remaining on the Res they retain their status as "Free Nations" they ARE NOT US Citizens. The large number of Indians who have served in the US Armed Forces , ALL volunteered, Indian's can't be drafted .
There is no requirement to remain on the Res. which with out Gambling, are usually little better than refugee camps, But if they leave they lose their Allotment.
Just like they did with the land its self, they are selling their rights to KEEP the boot on their neck.
But since you are so fixed on the obscure case, I assume you know squat about a visionary who witnessed the Custer battle as a young boy.
"Black Elk Speaks", I forget the Author or publisher, Some one else can supply them, I KNOW MB has read it  ;D
