The alternative is he actually tries to participate in Congress.   :o

Good point, like the guy in Florida looking at porn.....we might be better off letting them do that than actually trying to do something destructive.

This is the thing. Its the one point I agree with Kagan on. These hearings are a farce. Barring an epic gaffe, or someone giving a stellar response to a waivering senator, they are uselsess. The Senators give speeches, or cross examinations. They don't ask hard legal questions to learn about judicial philosophy. The nominess provide bland pablum that reveals as little a posible and ofends no one. iisaid before, I wanted to hear from her. I have. The answer is no. However I really do feel there is an obligation to listen before passing judgement. Its just about good manners and proffesional resposibility. She hasn't changed my mind. Now the farce continues. Dems will vote yes, GOP will vote no, and the fact that 5 is a bigger number than 4 wil continue to be our guiding Con law principle. >:(

Dems will vote for Dems, GOP for GOP unless there is an utter moron (think Harriet Myers) proposed. If they pass the "must be at least as tall as this sign" test, its rare to see the Presidents party vote against the nominee. The reverse is not true. A number of Dems voted for Roberts and several GOP for Sotomayor.
