Ok, this a thread "diversion" not a hijacking, all "collateral damage" will be "euphemized' and "misremebered". ;D Serously? The reason the ACLU hits on race is because the SC only ever enforced the "equal protection clause" of the 14A which was designed to help blacks (and now every other "protected class") and not the "pivledges and immunities" clause which would protect everyone. The ACLU (and everyone else) argues in terms of race or other "priveledged classes" because they have to. Read the Slaughter House Cases (1883 I think?) which said "the police powers of the states do not fall under the privledges and immunities clause of the 14th ammendment" thus effectively rendering them a dead letter. Its just like the 9A. "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.". Sounds good, but to the best of my knowledge the Court has never overturned a single law or conviction on those grounds. If that changed, and the Slaughterhouse precedent was dropped, we could start talking about ikndividual, rather than group rights. Hell McDonald vs Chicago was decided partly on racial grounds. I'll take the win, but it irritates me it had to happen that way.

Ok Tex, let me unwind that for you because upon rereading it? I get lost. My bad.. :-[ Short version. The 14A has been interpreted to protect group and not individual rights. The 9A (which should be the most quoted ammendment) is a dead letter. Thus every group from the ACLU to Judicial Watch to the NRA uses an equal protection (read race or religion) based claim even if they are tryng to do something as race neutral as overturn Chicagos gun laws. There's just no other way to get in front of the Court.

So FQ seems to be the legal version of  the newspaper rule "If it bleeds, It leads",
If it is a sexy career enhancing protecting a group, Blacks, Gay's , Catholics, whatever, the case will have a better chance than if it is based on dry Legalese like the 9th and 10th Amendments.

No, just statist judges, mostly on the right (for states rights reasons), but all the liberals too, none of whom want to extend "substantive due process". Translation from legalese? "Your rights will be enforced and government power would be radically curtailled". We simply can't have that ::).  Thus the priveledges and immunities clause of the 14A is a dead letter and the NRA had to produce a black plantiff to get McDonald passed. Hell, Heller? Roe? Tinker? All could have been settled by applying the 9A. If its not an enumerated power, the government can't do it. But no Court has gone there. I hope one does. The framers didn't write that ammendment out of whimsy. It was meant to be enforced. Its time "We the People" started insisting on it.
