Illinois is much the same way. In order to OWN a firearm you must first be in possession of a current, valid, Illinois FOID Card, (Firearm Owners Identification Card). You must apply to the state to get this, and it is totally up to them to issue it. If you let it expire, you are then in illegal possession of a firearm (s), and they can, and have confiscated them based on that alone. It simply gives them a reason to do what they want to do in the first place by skirting around the Second Amendment. The law is still firmly in place in spite of the Brady Law. They put you through a criminal background check before they issue one. Brady does the same everytime you buy a gun. Illinois has no carry law. So with Brady in place there is no need for a FOID Card. No matter, it's still there.
Since this whole Tuscon thing, and all of the political accusations and repercussions from it, politicians and law enforcement are getting paranoid. If you make any kind of statement that they think is threatening, there are going to be consequences, be they legal or not. They are playing off of fear, rhetoric, and everything else. The more liberal the state, the worse this will get. Look at New Orleans under Blanco and Nagan after Katrina. Same deal. Yeah, there were consequences afterward. But then it's too late. Your guns are gone. And if you get them back they'll be damaged and Electro Penciled up with markings everywhere, and there won't be a thing you can do about it.
While it is this guys right to say whatever he wants, it was stupid at this point in time for him to do so publicly. Now as a result his guns are gone, he's out big money, and he's got a mess on his hands that will more than likely cost him still more money to get straightened out. All for what? Testing the waters of his Constitutional rights. Kind of pointless. People are getting crazier by the day. Bill T.
