TOMAH, Wisconsin - Monore County, Wisconsin District Attorney Dan Cary says officers were justified in shooting and killing a suspect in a shootout April 22nd.

Investigators say a shooting earlier in the day led to a traffic stop that ended in the shooting of 28 year old Seth McCloskey.

Dash cam video shows McCloskey exiting his truck, pulling a pistol and firing on four officers who responded to the call.

McCloskey was hit several times as he retreated to the truck, which was rolling away from him.

Many more rounds from the officers can be seen hitting the vehicle.

One officer, Josh Kenworthy, was struck in the foot by one of the shots.

No one else was hurt.

Tomah Police are waiting for forensic tests to determine is McCloskey was involved in an earlier drive by shooting or to 10 other drive by shootings in Illinois and Wisconsin.

Moral of story. If you're going to be dumb enough shoot at cops, be sure to put your truck in "PARK", and don't stop until they are dead. If you don't, you soon will be, as evidenced here.  Bill T.

Rule 1 in Getaways:   Don't let your Getaway vehicle wander off on you.


Rule 1 of Pursuits: Put your police car in park so your cover/concealment does not roll away and leave you in the open and without a means to continue the chase if needed.

Nice job by the bystander in the pickup truck who makes the right turn and gets out of the way!

Too bad the houses in the background couldn't do the same. We all know how cops shoot.  ;)

I counted 53 from the cops, but I could have missed a few. The radio call should have said....A case fired!!!...Waiting for weapons to cool!!!  Bill T.

They shot every part of that truck possible from the back bumper to the roof.

That truck won't mess with the Tomak PO po ever again!
