15-year old charged with murder after home invasion

This was in my home county yesterday. A 19 year old and a 15 year old broke into an old man's home (armed) with the intent to rob (and possibly harm). They didn't know the old man's son was there also and the son shot the 19 year old in the head.

A 15-year old boy is charged with murder and burglary after a home invasion late Saturday night in Tift County.

Sheriff's investigators say the boy and 19-year old Roosevelt Clark broke in a home at 2914 Wilton Avenue and demanded money from the elderly home owner. The homeowner's son was in another room, heard the commotion, and shot the home invader in the head.

Clark was dead when deputies arrived.

The sheriff's office would not release the boy's name, but he will be charged with murder as an adult for being involved in a felony that resulted in Clark's death.

The homeowner is not be charged.

The investigation continues.

Seems a bit over the top to hit  a 15 year old with felony murder in the death of an accomplice. Yeah you CAN, but SHOULD you?................. ::)  Southern justice sometimes fails to make this distinction.Still, I won't shed tears either way, and its another example of why we need the 2A. Good for the homeowner!

Due to the ongoing investigation, the fact of the accomplice being only 15, there is probably other circumstances as to the murder charges.

TIFTON — A 19-year-old Tifton man was shot and killed Saturday night after he allegedly attempted to rob an 86-year-old man at his residence in the 2900 block of Wilton Avenue, authorities say.

At about 8:45 p.m. Saturday, a black male with his face covered entered the home on Wilton Avenue with a gun and attempted to rob an elderly resident, Capt. Mike Walker at the Tift County Sheriff’s Office told The Tifton Gazette Monday afternoon.

He said the man’s son, who is in his mid 50’s, was in a nearby room and heard the commotion. The son emerged with a weapon and confronted the alleged robber, 19-year-old Roosevelt Clark of Tifton, and shots were fired.

Clark was struck and died at the scene as a result of gunshot wounds, Walker said. He said the son was not injured, and no charges will be brought against him.


“Subsequently, we have arrested a 15-year-old juvenile as an accomplice in the robbery,” Walker said. “He has been charged with burglary and felony murder.”


According to the Georgia Code, “A person also commits the offense of murder when, in the commission of a felony, he causes the death of another human being irrespective of malice.”

Walker could only say that the juvenile was an accomplice and acted together with the other man.

He took part in an armed home invasion of an 86 year old man. Screw him.
You can say lots of bad things about pedophiles; but at least they drive slowly past schools.

If the old man had died I'd be there with you. But for the death of the guy who obviously was the one who set the thing in motion? A 15 year old is not too old to save, particularly since according to the report he hasn't hurt anyone, he was along for the ride. To paraphrase a Sears ad, "Boom!, What's that? That's reality dropping on your ass!". Maybe he's salvageable, maybe not, but I think with a kid that young you should at least hope that's the case. Without seeing his record I can't speak with any authority as to whether he is redeemable or not, but 15 and looking at a life sentence because his accomplice got shot? C'mon man.

That is why he is being charged, any redeeming qualities he has, or lacks, will be on display for a jury of his peers at the trail.

Who had a gun?  I think the assumption is the older perp was the only one but who knew and when did they know it?

Home invasion is dangerous, the kid is lucky he didn't leave in a bag.

 The only reason this does not have my full support is because I feel no Murder was committed since it was a justifiable shooting. However I feel the 15 year old has earned 20+ years in prison for this felony than involved lose of life.

Hey, as a many generation Southern boy, I can use those words with only a bit of sarcasm. At least I didn't say "The boy shouldn't have stolen more chain than he could swim with". ;) :-\
