Last I heard BATFE ruled it was fine as manufactured ...  but I have no link to that announcement.

It can be used as an arm brace as origanaly intended. Useing it as as a shoulder stock would be illegal.

That's what I read too.
""It may be laid down as a primary position, and the basis of our system, that every Citizen who enjoys the protection of a free Government, owes not only a proportion of his property, but even his personal services to the defence of it, and consequently that the Citizens of America (with a few legal and official exceptions) from 18 to 50 Years of Age should be borne on the Militia Rolls, provided with uniform Arms, and so far accustomed to the use of them, that the Total strength of the Country might be called forth at a Short Notice on any very interesting Emergency." - George Washington. Not that anything about our current government or its agencies make any sense....but...let's say you had this:

And you put the end of the buffer tube into your shoulder pocket and then rested your cheek on that foam cover...

Has the ATF commented on that?

You mean like one of these?

Suarez posted a picture with his cheek welded to the recoil buffer of a similar pistol and commented that it worked just fine like that.  No need for shoulder mount.

I question how much of that is accurate, and how much is due to the fact that he has been shooting since the stone age.
