In a prior career I worked as a merchant mariner and officer. Mostly casino boats and tour boats off of Navy pier in the Republic of Chicago. Did do a little tow work as well.
The Japanese boat should have yeilded the right of way by the rules of the road. Size matters but, as a vessel motoring in the open waters you are obliged to allow vessels on your starboard side to cross.
Now, having said that, these ass hats also had an obligation to stop and reverse their couses prior to the collision. It's garbage like this that costs sailors their career. That Japanese Captian or Mate that was giving commands will undoubtedly get fired or demoted due to the near piracy of these eco-phornicators.
